Advice please - Problems with Estate Agent?

Hi just wondered if anyone has had any problems with a company called Costa Villa Blue in Denia. We are struggling to get a deposit back from them even though they stated they would return the money if a mortgage could not be found. Is this legal? Feel a bit silly handing the money over in the first place but as they had put in writing it would be returned we thought it would be OK. Probably nothing we can do but would appriciate advice.

Probably an important lesson for everyone here at your expense I am afraid. Never never give an agent a penny as a deposit. If you like the property make the offer if accepted refuse to give a deposit and tell the agent your solicitor will manage the deposit with the seller's solicitor.

Second lesson source your own solicitor not one recommended by the agent.

I'm sorry but you won't get it back.  You made an offer the seller probably incurred costs and may have stopped marketing the property. You then pulled out because you didn't have the funds this is the reason agents "try it on" with the deposits.

Whilst you shouldn't have paid the deposit in the first place you cannot really blame them for hanging onto it

Thanks. We thought we would be ok as had it in writing that the money would be returned.

Won't be doing it again, you are right it is a lesson learnt.
