Last year, we published an article on this forum concerning our property in Gran Alicant, detailing an ongoing issue with a tenant who is an estate agent from Russia. This tenant has been refusing to vacate our property and has neglected to pay rent and utility bills for a period spanning ten months.
Update: After a protracted wait of eight months, we were finally granted a court date, scheduled for the 11th of April, as the tenant contested the eviction notice issued due to non-payment of rent. Upon arriving at the court prepared for the hearing, our legal representative received an email on the preceding evening, dated 10th March, indicating that the tenant's lawyer was ill and unable to attend the scheduled proceedings. Despite our lawyer's attempts to engage with the presiding judge, explaining our travel from England and requesting a fair hearing, our pleas were rebuffed, and the judge declined to communicate with our legal counsel. Consequently, we find ourselves compelled to acquiesce to the demands of the tenant, as seeking another hearing would likely result in a repetition of the delaying tactics employed previously. This episode underscores the apparent imbalance in Spanish tenancy laws concerning eviction proceedings.
