Curtesy Car

I recently bought a second hand car and was given a one year guarantee for the engine and gearbox. The gearbox has now developed a fault and needs a repair but the dealer says he can not provide me with alternative transport.

My question is, does anyone know if he is legally obliged to do so.

I don’t know for certain, but would think it unlikely with a second hand car. New one probably. But even in UK before we left some years ago, we found that although we always used the same dealer, and changed our vehicles regularly, courtesy cars started to come with an added charge for insurance. And were not always available latterly.

I would doubt very much if any dealership is legally obliged to offer a courtesy car. In the event that they do  you will normally have to transfer your car insurance to cover the courtesy vehicle. Have you checked that your car insurance doesn't cover the cost of a replacement vehicle in circumstances such as you find yourself in? This type of cover can usually be added to your insurance but obviously at an extra charge.

I have had repairs done at three different garages recently for jobs not covered under the guarantee and each garage gave me a curtesy car with no charge but I suppose the difference is I was spending money with them.

You could try contacting the Citizens Advice Bureau - https://www.citizensadvice.org.es/contact-us-form/

If you go to the link there is a number to call as well as the contact form option.

They should be able to advise you on the legal requirements for second-hand car sale issues.

Hi bustid,

When you bought the car, presumably you signed a contract of sale and received written details of the guarantee?  You should check your documents, as that's where I would expect to see whether provision of a courtesy car included.

Hello Kim, the only words on the contract stated that the guarantee covered the engine and gearbox for one year, and this seems to be the standard guarantee for used cars.
