The Padron

Just a reminder about the Padron which reiterates advice given on recent posts.

There is an article in the Euro Weekly News titled "Importance of the Padron" which states that signing on the Padron with a habitual residence "may have administrative consequences or tax implications".

This is only for permanent residents, not holiday home owners, ie only those who are fiscal residents in Spain.

I have also found this on https://moneysaverspain.com/municipal-register-padron-save/

MSS Tip

Watch out if you’re thinking of getting on the padrón at an address where you don’t actually live, *for example at a relative’s.* Some people do this in order to have **access to better hospitals or to pay less municipal tax on their car.**

Article continues below

Towns are cracking down on fraudulent registration. Penalties for public document fraud, including the padrón, come with a possible jail sentence of 6 months to 3 years.

*This refers to habitual residence, ie your main residence*

** This may also include discounted rates at municipal sports facilites or free bus passes. **

So, by signing on to the Padron you are stating that you live here permanently as a legal resident and are liable for Spanish taxation.

It may come back to bite you on the bum big-time.

I agree with everything you say however it's all too frequently undermined by official bodies demanding padrons from people who have no legitimate right to be holding one.

In addition to better oversight one possible solution to the problem would be to hold those actually issuing padrons to non entitled persons personally responsible for their illegal acts.

...

...

Would you mind giving some examples of when officials demand a padron please? My own experience is that it took 3 trips to the Ayuntamiento with extra documents and two drive-bys from the local police to get ours, it was like pulling teeth so maybe they have been caught out in the past!
I'm sure it happens but have no idea in which circumstances.

Thanks for this! Yes as with a lot of things in Spain there's a lot of people who don't know the facts about the padron. Some town halls hand them out like confetti as the more people on the padron the more money they get ! Our friends in Quesada have a holiday home and are on the padron. We had an argument with them because in Aigues they told us we couldn't get the padron until we were resident. My friend said Aigues town hall was wrong and didn't know what they were talking about as they didn't have many expats ! When we were getting our Residency and SIPs etc we could only use a padron that was 3 months old for address ID.  Again my friend said that "in Quesada padrons were valid 3 years and in Torrevieja they were valid 5 years!". Rubbish ! Made me laugh ! When you apply for Residency in Alicante it's the same rules for everyone. The outcome has been that they are now ex friends !!

This explains fully regarding needing a Padron issued within the last 3 months for certain things but only needing to actually renew it if you move or after 5 years.

As there is a financial gain for the municipallity, it seems some areas with high numbers of holiday home owners break the rules.

Yes and it gives Expats the wrong information. Non residents shouldn't be on the padron and you shouldn't need a padron to buy a car but try telling that to someone who has a holiday home in Quesada !

I'm pretty sure that our padrons were free when we first got them. We've had to pay something like a euro each when we needed copies. That's for Aigues.
