We’ve just purchased in Costa Blanca (deposit paid), but it’s only in my name as I was the only one who completed paperwork a couple of years ago (hubby got cold feet). He realises his error now that it’s only in my name. How in the future can we change to joint ownership?

This is a second home - not permanent.

To answer this question it is essential to know which type of document is "only in my name", i.e. public deed or private sales agreement.

Perhaps if you could flesh out the information you give?

I got a little lost; sorry

“Just purchased” “deposit paid” “completed paperwork a couple of years ago” I found these to be a bit at odds with each other. What paperwork a couple of years ago, if you’ve only just purchased? If you’ve only paid the deposit, then I’m guessing you can still complete the purchase in both names? Unless these signed papers say otherwise?

Sorry if that sounds like and inquisition. I only ask as I can’t quite understand 🤪🥂

Haha - joy of a late night message @Angebadge. 

We have paid deposit on property Our sale progressed quickly due to me having everything ready to go (no mortgage/Irish passport/NIE etc).   I did this a couple of years ago (bank account/solicitor/NIE/POA) while my hubby got cold feet! 

Obviously because he did not get NIE etc it’s only my name on the documents, which suddenly caused a bit of insecurity for him🤷🏼‍♀️. He is putting in 50% which is easy to prove

Once we (I) complete sale what would be the process to add him to deeds or an alternative. I suggested just getting a document drawn up by our Irish solicitor, just for simplicity. 

I assume apply for NIE - don’t want TG to ask solicitor just yet in case I cause her anxiety

I’m certainly no expert, but have seen posts on here of a similar ilk. Others will be able to advise I’m sure

So, just to be clear, you’ve got your NIE, hubby hasn’t. You’ve put a deposit on a property. Have you completed on this sale?

I would suggest you speak to your Spanish solicitor/ legal representative ASAP and urgently. Transferring property, to whoever, in Spain, is not as simple as “just getting a document drawn up” regardless of who does it. It incurs costs, and if I remember rightly, these are substantial costs.

As I say, contact your Spanish legal representative and discuss your options. It may be that if you’ve not yet completed the sale, you may still be able to complete in both names. 🤪🥂
