We have booked a visit to Spain on Dec 2 to April 3 are we over staying our permitted day's and what would be the consequences???

If picked up by Border control the fines range from €500 upwards. Exclusion from re entry for a future period is a further sanction available.

My own feel for this is - and it's purely a guess - is that an overstay of a couple of days may result in a gentle warning, an overstay of several weeks would result in a fine, and serial offenders would be considered for a hefty fine and a period of exclusion. A two week overstay? Your guess is as good as mine.

Now, obviously this hinges on being caught in the first place.

The knowledge on cases is limited because of several reasons - firstly that Border Control and the Interior Ministry have not provided data on the number fined or excluded so far, and secondly that those fined and/or excluded will be unlikely to post their experience on Forums like this. Additionally the rollout of Egate passport scanners at Alicante is ongoing and not yet complete. (Could overstays be flagged by a signal to Border Control from the Egate scanners?) So it's all still in the early stages.

Edit - in the case of a fine it will be interesting to see if one comes up! For example if you are in the process of leaving the country and have no means of payment what will they do? Detain you? Doubtful. One option would be to tag the passport for future visits and require payment before entry. Presumably at that point a non payment would mean a turnaround at the airport and you're on the next available seat back to the UK.

This is conjecture on my part, but there must be a system for it because Spain will have fined and excluded plenty people from other non EU countries in the past.

But everyone should please bear in mind that the system has come about because in leaving the EU, the UK has simply aligned with the regulations in force for all non EU countries. Spain and the EU are not punishing the UK, simply applying rules that govern ALL non EU residents.
