The ComraVenta is a purchase and sale contract, which must be completed and signed by both parties to a sale/purchase.

There isn't any point in creating one, as there are plenty of exemplars available online, some of which can be completed online and then printed. Examples:

There's also one on the GVA website, which you could download and complete on your computer, but it's got over-printing and so isn't really usable. I can't find a GVA one without that over-printing.

Both seller and purchase must complete and sign the contract, giving name, ID and address, full details of the vehicle, etc. Although most examples don't include a field for it, I suggest that at the point of signature you include the time and recorded mileage, and if applicable a statement regarding who is responsible for paying the road tax for the year of purchase.

The seller and buyer also need to exchange copies of their ID - DNI/NIE or passport. If you are buying from a company then you need a copy of their CIF.

You also both need to complete and sign the transfer form that you will have to submit to DGT.

At the point that the contract is signed and the money changes hands, the vehicle becomes yours.

Make sure that you receive:

Copy of the sellers DNI/NIE

Permiso

Tarjeta

ITV counterpart if applicable

Proof of payment of road tax

Any service history documents

Written warranty if buying from a dealer.

Make sure you both complete and sign the Modelo 02 transfer form - see part 5 of this guide.

Insurance:

Before you drive away, you obviously need to make certain that you are insured to do so. This can be easily overlooked if you're new to Spain and of the mindset that it's the person who is insured. 

In Spain it's the vehicle that's insured, and if the seller has already transferred his insurance to a new car, or cancelled it, then you need to make sure your own insurance will cover you.

It is possible to take on - subrogate - the seller's insurance, if he is willing to do this. This obviously needs to be sorted with the insurance company first, and you also need to ensure that the insurance is paid up to date. As with the car, if there are any monies owing on the insurance, then you will inherit the debt.
