How Community charges are applied

The company who manage the community charges in Almoradi have told me that it I miss one monthly payment, say for January and even if I send my monthly payments on time for all of the following months, they add a penalty charge of more than double on to every single month thereafter because they apply each payment to the previous month.

For example:

If I send 26 Euros in February, on time, they apply it to January and the extra charge

I then send 26 Euros in March on time and they apply it to February and the extra charge

Firstly, I have a record of sending a payment in January but they claim they never received it. Am I unreasonable to expect that if a payment was late, they would apply the late charge just to that one month and not all the months thereafter?

I'm interested to hear your views on this

Sounds like they still regard your January payment as outstanding so in effect making you permanently in arrears. 

Can't you just pay a further €26 to get back on track? ?

TBH at just €26/mth I think I'd probably pay at least 6 months in advance if not a year and be done with it.

Hi and thanks for your message.

I have paid the extra 26 Euros - that's the thing - but they want to charge me an extra 39 Euros fro every month over the past 4 months! 4 x 39 = 158 Euros

There's nothing in the community rules to say that they can accrue payments over several months, i.e. if one payment is missing to apply the penalty to each month thereafter

Hi Korinne,

Then you should challenge them on it - and sooner rather than later.  I'd send them a letter by registered post, so that you can track its delivery,  along with proof of your January payment.

Thanks Kim,

I challenged them by email and they just kept ignoring me. They knew I had guests wanting to use the pool and they blocked the key fob for tge pool until I paid so I had to pay but told them I am taking it up with them. I was hoping to go there in Sept to speak to them directly but with me restrictions I'll have to wait. 

In the meantime I can put it in writing and send by recorded delivery - not sure they'll take any notice. I spoke to  spanish lawyer but they wanted 500 euros just to send a letter! 

Does anyone else know any other lawyers who could help for a lower fee just for a letter?
