Could anyone tell me how long someone can stay in Spain, without residence and how long must one remain outside the country before being able to return? I ask this because if the required income goes up after Brexit, My pension won’t be enough to cover it but I would consider renting and going in and out of the country!

Hi Biff,

Currently, while the UK is still in the EU, you can stay up to 182 days, but you have to register as an Extranjeros (foreigner) after 90 days - this process is actually the same as obtaining residency. 

After Brexit and without Residency, you can only stay 90 days in a rolling 180 days - this is because the UK opted out of the Schengen travel zone - so if you use your 90 days in Spain in one visit, you will then have to leave the Schengen area for a further 90 days, before you can come back again.  Please note that France (and many other European countries) are also in Schengen, so if you travel to Spain via France, for example, your 90 days would start counting down as soon as you land in France, rather than Spain.  If you want to come to Spain for periods shorter than 90 days, you would need to keep track using a calculator:

to ensure you don't exceed the 90 in 180 rule.

Thank you Kim, I will just have to hope I can gain residency in 2 years when I get my second pension! If I got a part time job then that would cover it with my 2 pensions. However I may not be able to get a job without residency, so it is a vicious circle... The annoying thing is I had the money in 2012 when I was paid off as a civil servant and was at a language school in Alicante, I got called home for a hip replacement and then while recuperating spent the money I had set aside as they wouldn’t give me any help saying I had too much money in the bank! Wish that was still the case
