Hi Everyone hope you are all keeping well. I am just wondering if anyone can help? My wife and i usually come to Benidorm for 4-5 months of the year in Sept and don't have special visas or extensions on our passport do you think we would be able to come and go like we used to or are the authorities really clamping down. We usually book long term rental but don't want to waste my deposit if we cant stay for a while. Does anybody have any idea what will happen or will things change or would you just take the chance Thank You Frank.

You are limited to 90 days maximum stay in any 6 month period, there are loads of posts on here about it. It has always been this way even before Brexit but the authorities turned a blind eye to over stayers.

If you want to chance your hand and over stay your allowance be prepared to pay the fines etc, you would be breaking the immigration laws which will be monitored more now the UK is out of the EU.

I fully agree with Paolo51.....

If you stop longer than the maximum 90 days allowance you will be breaking various immigration laws and could possibly be banned from entering any EU countries. 

Maybe things might ease in the coming years but no one can give you a definitive answer.

The people that voted to leave did not know what they were voting for an now have regreted what they did. This is causing many problems for all of us.

Bit of a sweeping statement there, Of the people I know who voted leave none of them are regretting what they voted for. Changes such as the 90 days in 180 days rule have absolutely no impact to the vast majority of people in the UK.

Hi Frank,

According to article 53.1 of Spain's Immigration Bill, exceeding the 90 days limit could be considered a serious violation in the eyes of the law, with fines from €501 to €10,000, potential expulsion from Spain as well as a ban from the Schengen area for anything between 6 months and 5 years.  It really isn't worth the risk.

There was just one question on the referendum with two possible answers. This did not reflect the complexities and nuances of a vote to leave.

Hello Frank 777,

You’ve got your answer and sadly you won’t be legally able to visit for 6 months this winter unless of course you could obtain an Irish Passport which would allow you to stay for 180 days as before. As you probably know, you could rent for 90 days and return home for another 90 days and back to Spain again. It’s a big disappointment and I am sorry for you both. Make the best of it and go for 3 months. Probably wisest to choose January, February and March. You could probably squeeze Christmas in there too if that’s your norm. 

We can but hope that things will become more relaxed in the coming years.
