Hola,  I am moving back to England & will rescind my Spanish residency & tax status. I will still have an income in Spain though, from a rental business that my husband will run, in his name only. What are the tax implications for me & my husband? Thank you for your help.

Hi,

Too many permutations to give you anything more than general advice, e.g. if you're living permanently in the UK, you will be tax resident there; similarly, if your husband is living in Spain for 183 days or more, he will be tax resident here.

However, as you say you will be receiving an income from your husband's business, I would highly recommend you take advice from a tax professional.  There's a Dual Taxation Agreement between the UK and Spain, to ensure you don't pay tax on the same income in both countries, but you may still have to make tax declarations in both countries.

Kind regards,

Kim

Thanks for your advice Kim. I don't think I'll have earnings of over 5k, will that make a difference?

H8,

The UK personal tax allowance for 2021 is £12,570; for Spain, it's €5,550, so you may not earn enough to pay tax, but will still have to submit tax returns.

Kind regards,

Kim
