Are Estate Agent Deposits Legal?

Are estate agents in Spain professionally qualified and government legally regulated?. I have been told by some of them that I have to pay a substantial deposit to them or I cannot buy through them, I offered to pay via my lawyer but they said NO. Are they licensed to take clients money and is it safe?.

We have recently purchased through OP property in Gran Alacant,they were totally professional,arranged every thing and we paid  €3000 deposit

You should be able to do it through your solisitor but many won;t alow this most of them are totaly unqualified but not sure how you get round it!.

It is nice to see some members have posted good experiences on this subject. But in answer to the question about estate agents and furthermore the whole property industry, builders, developers, lawyers, banks, there is little if any enforceable laws and government regulation. This makes the industry ripe for corruption and encourages Spivs to operate. I find it amazing that estate agents have anything to do with handling deposits and clients money, this should be made illegal, they are not bonded in any way. If anything goes wrong you can take legal proceedings, but this will cost you legal fees and court costs and possibly 5 to 10 years to get a judgement, by that time the defendant and the money claimed have evaporated.

Why the government authorities don’t ban estate agents and developers from handling client deposits when it can be routed through a lawyer is beyond me. Perhaps someone wiser than me on this forum could explain.

So true but how can anyone explain! it is just the way Spain is good points bad pionts and if you want to be part of it make the most of it or leave! and this sentement that should be echoed in the UK with all the imigrants that want to change things!!!!!! think about it!

Exactly and choose reputable agents,ours took us everywhere,the bank,the notary and solicitors at no extra charge, would recommend OP Group to anyone,so good with us

I think the only person to ask would be a solicitor,just tried to get across using 

that using a reputable agent does put ones mind at rest that you are not going to be ripped off

Dave that is a very fair point. Problem for some Brits is that it is virgin purchase, brains are on the beech, Spiv estate agent takes deposit, sale falls through for whatever, estate agent wants to keep deposit.
