Padron? EX-18? EX-20? Assistance with understanding order etc... :-)

I have moved to Benidorm 2 weeks ago. The move was not due to take place until January/February but got moved at the last minute (thank goodness)....

Consequently, I have not registered or completed any paperwork as I was waiting for changes to be announced after Brexit.

I understand that I need to register "Padron" and have an appointment booked for the 5th April (being the first one available).

I also believe I need to complete a EX-18 to register as a foreign national and then a EX-20 to apply for residency...

I am confused as to:

1) Do these have to be done in a certain order?

2) Could I do the EX-18 and EX-20 at the same time?

3) Do I have to wait for Padron before submitting the 18 & 20?

4) Where do I have to attend for the 18 & 20?

Just to add I am continuing to work for a company in the UK. But I am classed as a "Homeworker" with my Home now being in Spain.

ANY assistance/advice would be gratefully received... at the moment the more I read the more I get confused.

There appears to be a process to register your intent before the end of this month ... but you need to be quick.

If you miss the year-end deadline, there are more/different hurdles to overcome.

I don't think you have got time now (unless you are extremely fast) to get your application for residency by 31st December 2020. After 1st January 2021 a whole host of different requirements will be needed to ensure your application goes through. 

You will need to prove your monthly income, paid into a Spanish bank account is as required.  You will need to prove that you have full healthcare paid for a full year. You will need to show a long term rental agreement or deeds plus a Padron which is less than 3 months old. You will probably need a work visa.

I have already registered with Babelia but they are only now processing the people already in the system and will not take anyone new till 11th January. However, they have indicated that as long as I can prove I am living here prior to the 31st December I can be dealt with under the current rules....

I was just going to start the ball rolling myself as I have the forms translated ready, I just did not know the correct process.....

I cannot get my paperwork in by the 31st December but as I replied to Kelvin above I have registered with Babelia who said I could be dealt with under current regulations if I can prove I was living here before the end of the year...

I have today applied for a Spanish bank account and have already purchased healthcare. I can prove a healthy income from the UK and have a 2 year tenancy agreement which started at the end of October (and obviously proof of paying my rent). I have my Padron appointment booked for the 15th April (the earliest one they had available). I just don't know the order I need to do stuff in....

I seem to be ticking the boxes you have mentioned.... Just bad timing.

Do you think I will still need a work visa if I am actually working for and being paid by a UK business? If so, no problem as I just want to get everything correct.

Thank you for your help - I can see I am likely to be pestering the forum for advice over the coming months....

I wish you luck but proving that you were living in Spain before the end of the year requires a tad more than sneaking in under the wire just before the clock strikes midnight.

There was a lot you could have done in the two weeks you say you've
actually been here, got your EX20 in in particular, but I fear your inactivity may turn out to mean you've missed the boat, the time to 'get the ball rolling' was the morning after your feet landed on Spanish soil!

Thank you for your reply. Believe me I did and have not stopped since. I have completed the forms, arranged bank account, booked Padron but was advised to go through an organisation or legal etc to ensure they are correct and I have approached all I could in the time. And as stated the first available padron appointment was 5/4.... I was definitely not attempting to “sneak under the wire” and started my rental in October but had to delay travel at that time as my mother was unwell. I don’t have a problem if I come under the 2020 regs or the 2021 regs I just wanted advice on the order to do things.

Hi Sandra and welcome to the forum 😀

The requirements for registering as a foreigner in Spain is the EX-18 and this should be done within 90 days of arriving in Spain.  However, as you're planning to live in Spain, I would expect Babelia to suggest you apply immediately for a TIE residency card, which is the EX-20 process.  The documentation you require is actually the same for both procedures:

- NIE (Spanish ID number)

- Spanish bank account 

- Padron

- Property Deeds or long-term Rental contract

- Proof of income (minimum €463 per month,  or €5,543 lump sum) *

- Proof of healthcare cover **

* These are the financial requirements for UK citizens applying as members of the EU.  If your residency application on that basis is rejected, you can still apply as a TCN (Third Country National), which we become from 1 January 2021, but the financial requirements are much higher: €2,100 per month, or €26,000 lump sum.

**  As a Spanish resident, you'll no longer be entitled to NHS healthcare in the UK, except for emergency treatment when making short-term visits there.  Is your employer paying for you to have private healthcare in Spain?

As you say you'll continue to be employed by a company in the UK, have you checked where your income tax liability will be?  If you continue to bepaid and taxed in the UK, whilst resident in Spain, you will still need to make tax declarations in Spain.  There's a Dual Taxation Agreement between the UK and Spain (not affected by Brexit), so you shouldn't pay tax on the same income in both countries, but hopefully your employer will know what is required to ensure you don't fall foul of the Spanish taxman. 

You don't mention having your NIE, but if I remember correctly, you can't open a bank account without one?  Other than that, it sounds like you're on the case on everything else, except healthcare?

There's been some great feedback about Babelia by other forum members, so I think you're in good hands.
