Good morning everyone

Please can you advise me on the following problem šŸ¤”

I have 5 year TIE (approved Dec 2020) and have paid an accountant to submit my first Modelo 720 asset declaration form. We are now in the process of completing my first full tax return for Jan to Dec 2021. Due to be submitted June 2022.

I have lived in long term rental properties from July 2020 to present date. 

My accountant has told me that he may be able to claim my rental payments for the period Jan to Dec 2021. 

As such, he has requested said costs and landlords name and NIE number. 

Unfortunately, I have since disposed of the original rental contract covering the period Jan to October 2021. However, all rent was paid by bank transfer and I can produce statements to that effect for said period. 

As such, I have contacted my former landlord and the letting agent to request NIE / contract copy. As yet, I have not received any replies. 

I do however, have provided him with my current landlords NIE and rental payments for Nov and Dec 2021.

Please can anyone advise if my accountant advice is correct and if so,  or how best to proceed to claim allowance without landlords NIE.

The landlords tax-ID should appear in you rental agreement (DNI or NIF). You do not need to prove rental payments unless requested by Hacienda. In any case talk to your landlord first as he may not want to pay income tax on your rentals. Depending on your taxable income, it may not be even worthwhile.

Yes, Im hoping the landlord contacts me soon to discuss further and hopefully provide their NIE no. 

I did also consider they may wish to avoid paying taxes due on rental income. Hence, no reply.. 

This experience has taught  me I need to keep original / copies of current / future rental contracts a lot longer.. šŸ‘Øā€šŸŽ“
