Claims for car accidents in Spain

Hi everyone, we were in a car accident on the N332 in mid November which resulted in my husband having a broken sternum and I had a broken wrist and a fractured vertebrae and I had to spend  10 days in Elche hospital. Someone pulled outbfrom near the lakes and drove horizontally across 2 lanes of traffic so we hit her head on. The police are taking her to court for serious bodily harm due to negligence. Her insurers are asking for us to have some medical documents from the UK translated into Spanish. Our insurers are Caser and are not being particularly helpful. Does anyone have experience of having to have medical documents translated for a car insurance claim. The whole experience has been really stressful. We have a holiday home in Spain, but don’t live there.

Surely it's a case of Google Translate and do it yourself?

If not, you could just ask on here for a translator and mail them copies of the documents to translate for you, for a fee?

Any foreign document then has to be Apostilled (legalised). This doesn't confirm what's said in the document, but confirms that any body or establishment concerned in it is recognised in Spain.I would imagine any decent translation company could do this (for a fee, of course).This may help;

Hi KazG,

A horrible experience and I do hope you are both recovering well from the trauma.

A word of advice, when translating any document that is to be used in an official capacity it is essential that you only use a sworn translator who is recognised by the Ministry of Foreign affairs. To not do so runs the risk of the document being rejected.

Here's a list of official translators in the Alicante province. If you want local to Los Balcones search through and you will find Torrevieja and Orihuela Costa.

Hi sorry to hear about your RTA and injuries received.  Why not speak with your Solicitor who will advise you on your claim.   Remember compensation for personal injuries in Spain is not like England or Ireland.   Your Solicitors will most likely have a registered translator (or will be familiar with one) so I would recommend this route.   They will also advise you on level of damages for your injuries and also what special damages you could claim i.e. loss of earnings, hospital, medical, pharmaceutical, travelling, translator etc.   Good luck with your cases and I hope you both have a speedy recovery.   Mary

Thank you. We do have a fiscal rep, but not a solicitor. We’re coming over to Spain soon so we’ll look into it. I realise the claim for injuries will take a while and we do have expenses such as travel  costs etc. I must say it does seem different here- we had to arrange for the car to go from the compound to a local garage and then we need to arrange ourselves  for the car to be taken for scrap.
