Hi Guys

Just some guidance please, if you own a property in the UK, which is tenanted and forms part of your income, and you are residents of Spain, is any tax liability from rent paid in Spain as income or to HMRC, as the property is in the UK.

Thanks

As a tax resident in Spain, you are taxed on your worldwide income, including any rental income you receive from tenanted UK property.

If you haven't disconnected from the UK tax system and still pay tax there, you will have the opportunity to list on your Spanish tax return any UK tax you have paid. This will be taken into account when assessing your Spanish tax liability.

Personally, I found it easier to disconnect from the UK tax system after year one and I only pay tax in Spain, even though all my pensions and investment income arises in the UK. It's easier, and I want the country I live in and benefit from to receive my tax contribution.

I understand that if property is in Uk then tax is due in Uk and also in Spain but that credit can be claimed for UK payment.

This may have changed of course since the B word.
