Hi good morning to you all.

This question may have been asked many times before but is is a real mine field when trying to Google the answers.

I am Irish married to an English woman we have been holiday in Cabo Riog for many years now and love the area. 

Is my wife able to stay 365 days in Spain like myself. I understand there will be forms and processes to Adhere to .  

I am away for a couple of days so please accept my apologies if I don’t respond to messages promptly. We both love this site and all the hard work you all do .

We are coming over again in about 6 weeks so even if any one wanted to meet up for a beer and chat that would be great. I’m 62 wife 51.

When you say “Is my wife able to stay 365 days in Spain like myself.” are you a fully fledged Spanish resident and living in Spain?

Hi , thank you for quick response , no I am not living in Spain at the moment but wishing to do so within a couple of years .

Hi Reg if I’m right even though you have a Irish passport you can only stay 6 months in Spain in one year if you go 1 day over you would have to pay all your taxes to Spain , with your Irish passport you would get residency very quick ,also residency becomes easier for your wife  your wife would still need to get her passport stamped every time she comes in and out of Spain ,until she became a resident , but yes she would be able to stay longer than 90 days as long as she travels with you , I would also suggest speaking to a solicitor I would recommend Mark at Sun Lawyers Cabo Roig cheers Marcus

Even as an Irish national, if your intent is to reside in Spain , you need to register yourself at a national police station before the end of 90 days after you land . You are , in effect , applying for residency but the procedure is much easier , faster & requires you to demonstrate a much lesser amount of funds to live on than a UK passport holder. 

Once you have that , your wife can then apply for residency as the spouse of an EU member and therefore benefit from you.

Hi so if your British wife of an Irish Citizen comes over with you and you apply for residency is she still liable to the 90 day rule cos by the time you put in for it, those 90 days will be expired because as I am led to beleive you can only apply for residency after 3 months is this correct. Also heard someone say that your wife might have to get a visa in UK before traveling anyone heard of that.

If you intend to become Spanish resident you can apply/register anytime before the 90 days are up. Once you have residency your wife can apply on the back of your residency status, which is a lot easier than applying via the NLV route. You'll both still need to prove that you have sufficient funds and will need private medical insurance.

Until then, if your British wife is travelling with you she will have her UK passport stamped but will not affected by the 90 day rule. However, if she is travelling on her own she may be subjected to additional scrutiny.

You can get an appt to get the Irish passport holder registered as soon as u land

Hi thanks for the reply much appreciated.To register will I need a Rental Agreement cos renting a friends property for the firat 3 months while we look for our property to buy, and he wont want to draw one up for fear of any comeback.
