Hi,

Can anyone recommend a property management company? We’re buying in La Regia but won’t be making the move for a while, so we’re planning on letting the property out as a holiday let, when we’re not using it.

Hi Alison

You will need to apply for your Tourist License before you can start letting to the holiday market, it is illegal to let the property without one.  Unfortunately that can take a year or more to get in this area, assuming the property is eligible for one (not all are).  It is a two stage application, the first stage is obtaining a Certificate of Compatibility from the Town Hall (slow part) and then making the application itself to the tourism office in Alicante.  

If the property already has a Tourist License then it can be changed into your  own name once purchase is completed, which is a fairly straightforward procedure that your lawyer can instigate as part of the purchase process.

You then need to decide if you want to hand the property over to an agent, thereby having little control over the rentals and paying agency fees on top of your Spanish tax, or if you prefer to manage the property advertising and bookings yourself but use a keyholding service for check-ins and cleaning. (I recommend Julie and Paul at paulhorton100.com).

If you handle the bookings yourself, then once licensed, you also need to register with the Guardia Civil so you can enter guests' details on the website when they arrive (just as hotels do). 

As a non-resident you will need to file a quarterly tax return and pay Spanish tax on your rental income. EU residents pay 19% after a few allowable deductions but non-EU residents pay 24% with no allowable deductions.

If you mentioned your intention to let the property as a holiday rental to the estate agent you used and to your lawyer, then they should both have informed you about the licensing requirements.  If you told them of your intentions and they haven't talked to you about the licence laws then I would start asking them why they haven't mentioned it as this should have been taken into account when looking at properties.  Your lawyer should also run a few checks before you sign anything committing to the purchase to ensure the community hasn't restricted the issue of any new licenses on the community and that the property meets requirements.

Please see the comment I posted above above about letting.  Do you already have your Tourist License for holiday letting?  If not, you can only long-term let.  As the two are very different in terms of the service you require from an agent and if you are doing one then you cannot also be doing the other at the same time.

If you already have the License then you can start advertising - you must include your License number in all your ads.  You don't need an agent unless you literally want nothing to do with the letting and who stays.  You can manage the bookings yourself using a registered keyholding business for the check-ins and cleans and who will also sort any emergencies.  Your guests must be registered on the Hospedarias website on arrival day - have you registered to obtain login codes with the Guardia Civil yet?  Also do you have your official plague yet?  

Whether you use an agent or not you will still need specialist holiday let insurance cover for the property, including public liability.

You will also need to submit quarterly returns and pay tax immediately as a non-resident.  If non-EU resident then a straight 24% of the gross rental income.  If you use an agent you cannot deduct their fees from that figure as a non-EU resident.  If you are in the EU then you are permitted certain deductions and tax is 19% of the net income.

If you do not use an agent there are many good options for free listings and you can use one of the paid options.  We book out every year using free listings and ads, but we do have a number of returning guests and get personal referrals as well as been renting for 16 years.  So allow for one or two paid adverts while you get established.  By handling the bookings yourself you can decide who stays and when.

If you use an agent then they will handle all the bookings on your behalf then pay you the rental less their fees/commission - but you still have to declare the original full rental paid by the guest in your tax return.

As we wont use an agent I cannot recommend one but there are a couple who advertise on this forum.  Alternatively ask on local facebook group.

If you decide to go down the long-term letting route then there are several estate agents in the immediate area who also handle long-term lets and are all fairly desperate for more listings, so sound around for the best deal.
