Hi all, I m German living in UK snd my German dad wants to bequeath me his house in Cabo Roig. He stated this  in his German will but I have heard that it needs to be logged with a Spanish solicitor or some paperwork filled out in Spain otherwise I might not get it or there will be complications, with the possibility of the Spanish banks confiscating it?!? Slightly panicked over here

Unless there is a Spanish mortgage on the property there is little chance of it being confiscated however it's essential that there be a properly notorise will in place, is there?

Hi thanks for your response; theres definitely no mortgage on the place. But only a German will. Does my dad need to set up a Spanish will?

To avoid complications, it is advisable for ex pats living in Spain to have two wills, a Spanish one dealing solely with their Spanish assets, and another in their country of origin dealing with their other assets.

This is what my partner and I did, it's not expensive. We used a highly recommended notary in Almoradi, José Carlos Pérez Juan. Cost us around 70€ each, including providing translations of the wills into English. The notary then makes sure the will is registered with the correct Spanish authority.
