Someone has now changed our mailbox lock without our knowledge- I think it's our nasty neighbour

You may or may not be aware of some of my previous posts where we spent years and a lot of money evicting our tenant for non-payment of rent , who happens to be the son of the self -proclaimed President of our block .  

There isn't any legal 'Community of Owners'  , no AGM minutes, accounts , administrator , comunidad, red book or other ledgers signed off by a notary.  

Just this nasty neighbour of ours who claims to be acting President/Secretary  who seems to have keys to all the important areas of our building , including the roof , water cabinet and electrics room where all the main supply sockets are located . 

Having sole access to these areas , he's caused immense trouble by taking revenge on us for evicting his son.  He has pulled off electrical wires from our mains power supply , switched off our water several times and refused us access to our water stopcock by locking the door to the roof and also locking the water cabinet. Further, him and his son have also broken our door locks and assaulted my brother (that was a few years ago).

He is well known to the local police but they seem to do nothing about his criminal acts apart from giving him a warning, no matter how much we complain to them. We've not heard anything regarding the denuncia we raised against him last May 24 , so maybe the courts have decided it's too trivial an issue.

Anyhow , since we evicted his son , he has never given us the keys to our mailbox and we know he's been stealing our mail but we cannot prove anything. We don't expect any important mail because all our utility and tax affairs are done online so there is nothing confidential he can access via our mailbox (which we've never accessed).

My brother visited his apartment yesterday to find that our mailbox lock seems to have been changed!!!!  How weird is that!  Why would our neighbour change the mailbox lock that we've never had the key for?

Also , a plumber visited our apartment to fix a leak and pressed the intercom button for our flat,  but apparently some lady answered through the intercom, obviously from another flat in the building. 

So it seems our mailbox lock has been changed but also our intercom button routed to some other persons flat in the building. 

Now we are wondering what dastardly deed this neighbour is planning to do (if it is him). Any ideas?

I thought that no locksmith can change a lock on a mailbox or property door without some legal proof of ownership, yet our mailbox lock has been changed without our knowledge.  So I've already contacted 2  local Calpe locksmith's ( there are only 3)  who claim they've not done any work at our building address.  Just waiting for a reply from the third who is relatively new to the area.

The sooner we can sell this apartment , the better for our mental health as it's been the perfect 'White Elephant'.

Hi Keith,  when you purchased the property, your Legal Rep should have made sure that all necessary keys where you needed access where handed over, so I'm not sure how the areas you are required to gain access to are being restricted!  

What are the thoughts/feelings of the other residents around you towards this person?  Has or is anyone else having issues with them?

When you sell, you too are going to have to be able to provide the keys to all the areas needing access, so maybe you need to take stronger legal action rather than just reporting it to the Police?

I really hope and pray you get this resolved.  If there's one thing that still really gets my goat, it's people acting in a bullish and bullying way towards others.

Keith, you need to see a solicitor and take details of all the problems he has caused you otherwise this will continue ad infinitum. You are not going to get anywhere on your own. I accept this will be another expense but surely now your aim is to get this flat sold and to never have to angst over this again.

My father (now deceased) and aunt purchased the property in 1980 when we had a proper Comunidad Organisation running the building. I think they were called 'Mediterraneo' .  No keys to the shared areas were ever given to us , just the key to the entrance door to the building.  You can imagine that there were very little legal rules in 1980 being applied in Spain back in the 80's.  This nasty neighbour's family caused so many problems for Mediterraneo , that they decided to cancel the contract , while our neighbour setup their own 'Comunidad Organisation'  with their own secretary and non qualified administrator .  I think it was a scam to make money for themselves but it ended up with 'Community Of Owners' being dissolved sometime during the banking crisis in 2008.  I have the CIF reference and there is no record of them in the Business Registry database anymore.

It seems that the few flat owners in our building are too apathetic to have a proper company run the building or cannot afford to pay for one. Many of them dislike our nasty neighbour and regard him as 'scum' but do not wish to take any responsibility for taking on the President role.

Our solicitor is well aware of our problems as we have contacted him each time the nasty neighbour has disrupted our lives. He even visited the Chief Of Calpe Police , but they say their hands are tied and it must go through the judicial system.  So we raised a denuncia last May 24 but have heard nothing since.

Obviously , we've spent over 5  years going through the courts to evict the nasty neighbours son because they used free legal aid helping them to drag the eviction using various legal appeals (even producing fraudulent documents to fight their case). It ended up with the 'drug addicted' son being finally evicted and owing us £11,000  pounds in court costs and unpaid rent which he will never be in a position to pay.  

Personally, we are mentally and physically exhausted using a police and judicial system that doesn't seem fit for purpose.  Best we just try and get rid of the flat as it's obviously a never-ending personal gripe between the neighbours family and ourselves.
