Permission From Calpe Council To Install A Front Door

I've just heard that one needs to apply for planning permission to install a front door . That Calpe Town Hall charge 80  euros for their permission to do so !!!!!  If this is correct it seems like an unfair money-making exercise.

Has anyone else experienced similar issues when trying to improve their property's security  and is it the norm in Spain that even small improvements need planning permission?

Hi Keith,

Are you replacing an existing front door?  If you're cutting into walls to increase the size of the door opening, you should check with your Town Hall, as you may need permission, but if you're just replacing the door, you don't need permission from the Town Hall. 

However, if you're property is on Community of Owners, you need to check with your President or Administrator, as there may be a community rule that says you need to seek permission.  For example, a friend of mine lives on a community where the owners aren't allowed to change the exterior paint colour of their properties, including their balustrading.

Hi Kim

Yes , we had to cut into the walls to install the security door . It was an emergency situation so we're contacting the Town Hall and explaining the situation (ie. someone broke into our place and there is evidence of drug usage) where we had to install urgently. 

With regards Community of owners permission , we've still not received any reply from anyone in the block about what the status is (ie. is there a legal 'Community of Owners', who is the President, where are the annual account and AGM minutes , etc).  We've put letters (in Spanish) requesting the information under each flat owners door, including the one occupied by the claimed 'President'.

Note that we also sent letters via our Lawyer by Burofax to the registered address of our 'Community Of Owners' last Jan'21  after the eviction of our tenant but still no response.

Hi Keith,

It sounds like you've done everything that could be deemed responsible and reasonable under the circumstances.  If your Town Hall confirms that either permission is not required, or they will retrospectively grant the relevant Works' Licence (our 'Minor Works Licence' for a new 5m x 3m hardstanding cost the princely sum of €33!), then I wouldn't give any further thought to the existence of a Community of Owners.

Does this mean that you've finally regained control over your father's property?  I do hope so and that you and your family can at last start to regain some peace after the trauma caused by your former tenant.

Hi Kim - sorry for the delay in replying

Yes, we've done our best to contact the 'Community of Owners'  and I can't find their CIF registered on the official 'Spanish Company House Search'  website. 

None of the residents have responded to the letters we posted under their doors requesting more information so there is nothing else we can do. 

I still have suspicions that the 'claimed'  President  or 'Community Of Owners'  is no longer a  legal entity or abiding with the 'Horizontal Laws' and am unsure what other actions we can take other then requesting some EGM to discuss the situation.  I would prefer that the 'Community Of Owners ' to be properly managed by a professional company like 'Mediterraneo Administracion De Fincas' (who manage the adjacent building blocks) rather than the current regime (if they exist).

I don't think we can have any peace until the flat is renovated and sold off and we cut any future ties with Spain and its unfair laws and bureaucratic tax systems. It seems that every which way you turn to resolve a problem, you have to pay for each step in some convoluted process.
