Rental License Information

Hi, we are currently in the process of buying a property in Spain which we will want to rent out. We are confused as to one of the regulations for obtaining a rental license. The rules state that the bathroom must be a certain sq footage. Is this minimum footage applicable to all bathrooms in the property or does just have to apply?

Any help you can give would be appreciated

Regulations depend on location, better contact a local "tasador judicial", they know it all.

Hi,  thanks for that - yes seen this - but it doesn't make it clear if both bathrooms/ shower rooms if you have them have to be the minimum size!

I will investigate further

Hello Alison, I´d do what Killjoy suggests. From what I´m hearing, even if all the other requirements are met, there is no guarantee you will get the tourist licence. It has to be passed by the local Town Hall first and some are being refused if they are in a residential area. Some urbanisations will ban them within community rules and you also need to know what your obligations are as they are quite onerous. At the moment it is taking months to get a licence so don´t expect to be up and running for 2019 high season. Davebev1 have done a brilliant 6 parter on here so is well worth reading. I´m sure I´ve read somewhere that sizes of en-suites can be smaller but to be honest, I´ve read so much on this that my head is spinning.
My only definite advice is not to act on Estate Agent´s promises.

Stated bathroom size for Alicante is 4.5 square metres. As long as one of the bathrooms is that size then property would still qualify on that point. So if you have to advertise as having one bathroom you can say on the proprty details that there is a small en-suite or second bathroom. You will not get the license if all bathrooms are under 4.5 square metres if the property is inspected (which they should be now). Engage an independent solicitor who obtains licenses, state in writing that you will need a license. If you find a property make the offer subject to your solicitor being able to investigate the suitability of the property for a license and only lodge the deposit with your own solicitor (not the agent) on the understanding that it will not be handed over and nothing signed until initial checks have been made. Unless I´ve misunderstood your post, your main concern will be getting the Tourist Licence in the first place. Search Tourist Licence in Everywhere and read all the above posts, the rest should become clear during the process. Until you have the licence you cannot even advertise. Follow DevBev1´s advice above and get professional help. It applies to all holiday lets. Hotels and multiple lets have different rules.
