Dear All,

My parents purchased a 2 bed Finca near to old Castalla town in 2004 and we enjoyed many family holidays together. They have not been out there in 5yrs as my Dad became poorly and died. Rather than sell it, my husband and I would like to move there permanently and set up a small glamping business with 5 geodesic dome tents as we would need to still earn money as we would be giving everything up in UK. Researching, I have learned there are different laws for different land. The land is classed as rustic and is 4000m2. Would I be given permission to put the tents on the land? Would it make a difference to permission if I farmed the olive trees? What is the worst that can happen to me if I just put the tents on the land? I am so upset, I had a clear plan in my head which has now become very blurred and out of reach. I really don't want to sell the property as my father adored the place and want to keep it in his memory. Does anyone have any experience with the town hall regarding this matter, is there anyone there that speaks English that I can contact?

Thank you, I have spoken to a Spanish solicitor in Alicante who has said that residency shouldn't be a problem. The problem lies with the size of the land and wanting to put 5 tents on it.

So sorry to hear about your loss. I would like to wish you good luck with this because it's a great idea but unfortunately I don't think it will work.

You would need all sorts of permissions including permission to let the glamping tents. Rustic land - Campo - is protected from living accommodation and it's very hard to get permission to do much with it.

It sounds a wonderful idea but if my best friend was asking my advice I would politely try to discourage it because it could become a headache you regret and I'm sure your father wouldn't have wanted that for you.

Keep researching though, as 'farming' may confer some rights I'm not aware of.

But definitely don't put anything up without permission, it will lead to fines from the Town Hall.

Thank you, I wouldn't just put the tents up as I know I would get in trouble. Just feel like doing that!!

Hi Bella,

Dinnerout's post is spot on, it is a great idea. 

Just a few more things for you to check on before you embark on what could be a lengthy process of applications and endless paperwork. If you did embark on the process check to see if the below is all correct before starting anything.

Has the house been transferred into your names ? A lot of properties built on Rustica land have not got full facilities, electric, mains water and suma registration ? I am not suggesting yours is but many are classed as "illegal". 

There are many historic and ongoing sagas of people who have fallen foul, most through no fault of their own, and not all, but most at great expense to them in money and stress.

If you thought about doing something similar in the UK with the permissions required depending on location (I would draw a comparison with green belt land) with nothing similar there before, then the same process would definitely not be for the faint hearted. 

Add the language issues, bureaucracy, and general Spanish differences then I am sorry to say times the difficulty by 10.

If everything is in place and you go for it I would love to hear how you get on ! Good luck !

Hi,

House hasn't been transferred yet but will be at some point. It has access to water and electricity and is registered with Suma. England charges to much for land for me to able to do this, however you do not need planning permission for tents in England. 

In terms of language, if I was to be given permission, I would ensure I would learn, my family is Italian, so shouldn't be too difficult.
