Dutch Government 'No Deal' Solution for UK Nationals

The following announcement has just been published for UK citizens living in the Netherlands with a no deal brexit. If the EU is consistent in its approach, we could possibly expect the same for us in Spain.

"On 7 January the Dutch government announced its solution for UK nationals living in the Netherlands in the event of a ‘no deal’ scenario. Under this scenario there will be a 15-month transition period until July 2020. UK nationals residing in the Netherlands before 29 March 2019 will retain existing rights to live, work and study.

The Immigration and Naturalisation Service (IND) will, during the transition period, invite UK nationals living in the Netherlands to apply for a permanent residence permit, without being subject to any integration or language requirements. The permit will be granted to everyone currently meeting the criteria for EU residency, including non-EU family members.

The criteria for UK nationals will be the same as those for EU nationals. UK nationals living in the Netherlands for more than 5 years will be granted indefinite leave to remain in the Netherlands. UK nationals who have lived in the Netherlands for less than 5 years will be given a temporary permit; when they fulfill the 5 year criteria, they will be able to apply for a permanent permit under the same conditions as EU citizens."

All they all have to do is ratify and ring-fence the existing agreement on citizens rights, no need for individual actions by member states.

But if there's no deal, there isn't any agreement on citizens rights. It would also have to be conditional on the UK allowing free access for any EU citizen in the UK.

Without intervention by individual member states, as no longer being EU citizens, we would have to be categorised and treated under the common immigration policy of the EU.

The Dutch proposal is a very welcome first move, which hopefully can be used as a format for other member states. I particularly like the use of the word 'invite'.
