I have a neighbour .....

He lived/worked in the UK all his life.

He retired. He moved here to Spain in 2017. Gained Residency in 2018. Pays his income tax in Spain - exemplary behaviour.

Then .... he took advantage of his Irish ancestry, and obtained a ROI passport.

And then .... he allowed his UK passport to lapse.

So ... he thinks he'll switch his Residency Card for a TIE. But his Residency Card has REINO UNIDO on it, while his only valid passport is Irish (and he needs to produce his passport for the TIE process).

He has popped into our local gestor to ask the questions ... (a) does he need to get a new UK passport and (b) is his current situation legal ?  The gestor is trying to find out.

Anyone else come across this ?

Surely if he has an Irish passport, then the restrictions on UK nationals after Brexit will not affect him as he is still an EU citizen. If his residency permit says Reino UNIDO, then a lawyer could help sort this, or the Irish embassy. Northern Ireland is classed as Reino Unido in Spain and many Northern Irish have Irish Republic passports. If you have an Irish passport you can still keep your UK passport - if this has lapsed then you could discuss the matter with the UK embassy.

I also have dual nationality/passports, but I ensured my patron showed Irish to ensure I got my residency card the same. If he's let the British passport lapse, then I would guess he will need to start the process again, from obtaining patron (As Irish) and applying for residency (with new TIE system). If he needs a lawyer to help would recommend Sun Lawyers (near La Zenia). Tel: 966730661
