Just checked my stays here in Spain on the Schengen calendar and it shows that i will have stayed in the Schengen area for a period of 92 days. This means that i am over by 2 days if  stay from the 15 May to 24 June. Problem is that i have booked my flights already. If i change the day when i arrive here from the 15 May to 17 May then this brings everything within the 90 day rule. Should i change / buy a new flight or doesnt 2 days matter????

2 days very much matters!

Having an over stayer stamp in your passport is something you definitely do not want and can see you barred from entry for up to 3 years!

Yes, it matters. An overstay, no matter how short, would be illegal and could prevent you returning to Spain for some time. You don't want to end up becoming an illegal immigrant. Better to get that earlier flight which keeps within the limits.

Has anyone actually been prosecuted for over staying ?

Just wondering how strictly the rules are being applied, especially in the circumstances of the OP where the over stay period is a few days .

For every inch given, people will take a mile......

If the rule is 90 days then it's 90 days!!

You would face a fine for overstaying, it's better and probably cheaper to change your flights. You can read information on the Schengen website about what happens if someone overstays.

Aitch.

Why don't you try it out, give it a go and let us know the outcome.....
