Closing of tourist accommodation - looking for clarity

Spain are to close hotels, short term tourist accommodation as reported in the Express;

The new rule will affect all hotels and similar accommodation, tourist accommodation and other short-stay accommodation, camping sites, caravan parks and other similar establishments, located anywhere in the national territory. One report says 12.559 will be affected.

We are currently in Airbnb till 15 April and had planned to stay longer, probably another 3 months.  Is Airbnb claissified as short stay ?  could we still rent an apartment for another 3 months or is this also classified as short stay accommodation?

Could you enlighten us on how we stand being non residents and staying in our own property and adhering to the rules and are/were in the process of applying for residency before the public offices were closed to us. Also we should have been flying back to the uk on the 29th March but our flights have now been cancelled. We feel more safer, healthier and happier here than we would in the uk as they are still trying to get their act together and there is no toilet roll because of panic buying! Are we classed as a burden on the Spanish society.

Hello Peter, you are not alone with so many Brits coming over to beat the deadline. You came intending to become residents, you have your own home here and it will be safer for you and everyone else to stay put. Get yourself a gestor who can get everything prepared and possibly be able to get an early appointment once everything is back to normal. Keep whatever you have to prove you have been living here since ......whenever. Stay safe.

Hi Ray,

My reading of the part of the decree marked "Second" is that where tourist accommodation enables the tourist to conform to self-isolation (separate cooking and washing facilities etc) AND that tourist or tourists were already there on March 19th, they are allowed to stay - with no limit on how long they can stay for.

This fits with the enquirer's position and means they can stay as long as they like (or as long as the landlord agrees to extend their rental for).

I believe we will be able to stay longer as per below, haven't been able to find a definition of long stay accommodation - will keep looking.Many thanksDenise

Order SND / 257/2020, of March 19, declaring the suspension of opening of tourist accommodation establishments to the public, in accordance with article 10.6 of Royal Decree 463/2020, of March 14, by which A state of alarm is declared for the management of the health crisis situation caused by COVID-19.

Last night the suspension of opening to the public of tourist accommodation establishments was published. Of all hotels and similar accommodation, tourist accommodation and other short-stay accommodation, campsites, caravan parks and other similar establishments, located anywhere in the national territory.
Exceptionally, the provision of surveillance, security and maintenance services in these establishments is permitted.

Long-stay and seasonal tourist accommodation establishments are allowed to open to the public those tourist establishments provided for in the first section of this order that house customers who, at the time of the declaration of the state of alarm, are staying in a stable and seasonal, provided that its occupants have the infrastructures, in their own residential spaces, to be able to carry out the activities of first necessity in the terms established by Royal Decree 463/2020, of March 14, by which the state of alarm is declared for the management of the health crisis situation
However, these establishments will not be able to admit new customers until the suspension provided for in the previous section ends.

The closing included in the first section will take place at the moment in which the establishment does not have clients to whom it must attend and, in any case, within a maximum period of seven calendar days from the entry into force of this regulation.

Does the airbnb you are staying in have a Tourist Licence? If it does it will be classified as short term, if it doesn't but offers short stays on the advert, it will be illegal. 
If you stay you do risk being turned out by the Guardia Civil and possibly with a fine.
I may be wrong but I cannot see airbnb being classed as long term accommodation because of the different contract you would need to be renting it under, either a seasonal let or long term where the tenant would have the right to stay for 8 years.
All properties which have been granted Tourist Licences have to have cooking facilities and adequate bathrooms, the provision of these is not optional.
I may be wrong, but I think you will need to get out. I would suggest that you seek help from an abogado first thing tomorrow so you know exactly where you stand.

I do not think, if you are planning to stay, that you need to go back, once you are here, I guess it is better to just stay, obviously will have to stay at home and only go out for very necessary shopping (food, chemist). If you need somewhere to stay or help whilst here, let me know.
