Problem neighbour with dog. Need advice

Hi everyone,

We bought an apartment here a few years go for our holidays and we love it. Our flat is on the top floor and there are 5 other apartments. Unfortunately, a problem has arisen with with the couple who live on the same floor. They have a dog which they let loose at all times of day and night to run about and do it's business on the upstairs terrace. Not only is the noise a problem but on many occasions,  if we enter the building, the dog comes to attack us, barking loudly and snarling which is quite frightening when you're not expecting it. We have tried to communicate our displeasure at this both verbally and by WhatsApp but, so far we have only been met with hostility. The latest incident took place today and again there was more hostility and quite blatant racism. We consider ourselves the perfect neighbours, here a few times a year, pay all our service charges and make no noise. Could someone please advise us whether this a police matter or a council matter?

Oh dear!  Perhaps present the dog with a bowl of dog biscuits, and then it might start behaving.  Train it to your commands.  Dog has to first sit and stop barking, and then present a few biscuits in a bowl.

Do your other neighbours have the same problem? If so, several of you can denounce the owners to the police. 

It is not an offence in Spain for noise before midnight. If it continues barking after midnight then you have a case for the police. Make a note of when it barks at night so you have evidence to put to the police. If you do call the police after midnight, they must hear the dog barking to do anything about it.

If you think the dog is being mistreated, report it to the Seprona (animal protection agency) who are located with the Guardia Civil.

You have said you approached the owners but got no joy. Have you approached the community president? Others may have already complained so they would have a case to put to the Guardia based on that.

We had a dog on our community that the owners would let out at 5 in the morning and it would start barking. After a couple of days I opened the door and shouted "Shut that &^*%% dog up" rather loudly. Haven't heard it since.

The barking is not really the problem here, although the noise of the dog running overhead at all times of day and night is, it's more the the threat of being savaged as we enter our flat. You walk up the stairs and all of a sudden you have a ferocious dog in your face. We feel on edge leaving our flat, using the terrace or indeed using our storage space on the terrace. This can't be right surely?

Sprinkle some pepper or chilie powder on the ground and on some tape and place it on the stairs, and in other places near to the dogs.

Haha thanks, that might be something for the future, but we're trying to solve this as amicably as possible although that seems impossible so far judging by the resistance we've met so far. Obviously people get into their habits and we are seen as outsiders but that's no excuse.

Reort it to Local Police,they will usually call on the owners,check on paperwork for dog and issue a warning.

Personally I'd invest in a water pistol and spray it at the dog every time it came near.
