Hi 

I have been hustled ... the term is weak somehow 

By the Suma to pay plu valia since si bought a house 4 years ago 

They are asking us to pay 1000€ each 

My wife and myself !

During the transaction the seller did not make any plu valia , the seller lost money and after selling the house to us , he left Spain 

Now Suma has Been on my back since 

The counselor in charge of the transaction wrote a letter to Suma explaining that there was no pluvalia in the transaction plus I gave the vendor original deed and my deed showing all the figures that there was nu plu valia but they are still insisting on the ground that I submitted the paper work and proofs a year after the transaction 

Looks like all means are good to take money 

From us , this is all illegal , but they are pushing to make it legal using all means so if anyone has faced a similar issue with Suma please advise us how we should go about it 

If anyone can advise a good Lawer dealing with these kinds of pluvalia issues please advise 

I would be grateful for That 

We also would like to know what are the means of recourse in such cases , hope We would not have to go all the way to the European court of justice for this matter

If not specified otherwise in the purchase agreement, the seller is the only  responsible by Law to pay "plus valia".

Hi M,

Plusvalia is usually the responsibility of the Seller, but if they were non-resident, the Town Hall can find you, as the Purchaser, liable for this tax.  You need to check the residency status of the Seller with your lawyer (they should have done this when you bought the property).  You have 30 days to pay the tax, but if there was no increase in the value of the land, you can claim a refund and you have up to 4 years to do so.
