Jim, I have now (but not before) it would take a while to sink in though. I didnt realise this is what is required to stay for periods of 3months or more without overstaying 6mnths and then becoming a fiscal resident. I thought it would be a different process in that case, a less complicated or permanent process. If done before Brexit would we then be able to have lengthy stays upto 183 days without the 3mnths in 6mnths situation I have been reading about? We want to stay in Spain for upto 6mnths but keep UK residence for 183+days and stay UK tax residents. If we apply for S1 health forms are we still able to get treatment in UK?. I think I,m still confused (maybe too thick to understand) lol.

Don't worry, Pauline, it confuses everyone at first.

I've never understood the need for a residency certificate for stays of more than three but less than six months, but it is what it is. Yes, a residency certificate is a way of getting around the 90 days maximum rule. As you indicate, keep it less than 183 days in a year, and you avoid becoming fiscal resident here.

Unfortunately, post-Brexit it's all going to change and a long stay visa plus a residencia card will be required:

Applying for an S1 and registering them with the Spanish health service effectively moves your health cover out of the NHS. If Margaret or myself return to the UK and need treatment, we would have to use our EHIC-E cards.

Oh Jim, what a nightmare, read your last link (think I had read it before now) and felt overwhelmed again. Financially we wouldnt qualify under those terms but we,re not living on breadline either. Very few retirees would qualify at those figures. I really dont know where to turn, I dont want to find we have a house in Spain we can only visit for less than 3 mnths in a year.Is it going to be a waste of time applying for residency before Brexit (when we dont want to stop longer than 6mnths in future) if it all changes after the date? I,m concerned too we would have to give up our UK NHS cover to get S1(to apply for residency) and yet need its protection especially as we have 6 repeat lifetime medications between us. Of course the "leavers" would never had imagined the problems that decision could cause. I dont drink but feel like taking up smoking again. Your information is so invaluable.

I agree with Ray. What the law says and what happens in practice very often differ, plus there's always the hope that there will be a Brexit deal which might affect the situation.

I totally agree with your thoughts Ray but my concerns are what I should be doing now, if anything so I,m not left owning a second residence I can barely visit. Your thoughts I feel are more biased to full time residents as you say you" live" in Spain. I want to live in both equally (ie.1 day less in Spain).

In that case I suggest you wait and see what happens re Brexit. I think it would be too great a risk to commit yourself now, especially as there are only a few months to wait for the outcome.

Thanks for your views Ray and btw I do pay my taxes. It is just not possible for us to commit 100% to Spain at this moment for various reasons and your comment of a foot in each camp is somewhat ambiguous. Is that how you feel about all non resident homeowners who want to use their home for holidays then? My investigations are to ensure we stay legal and avoid unnecessary limitations. I wish I could be as benevolent as you to Spain but in 12yrs, I have had 3 burglaries, first a total 5 ton(weight in removal lorry at time) of possessions totally ransacked, an Insurance Company refusing to pay out over a bogus reason, Renfe stealing our land and paying us a pittance in compensation, a corrupt translator to get her boyfriend a big job, who caused me a 14,000€ fine, a builder who left me with shoddy work that caused me to pay out a second time of 3,000€, oh and an estate agent who didnt pay my tax money and also stole other peoples deposit money and disappeared. I,m sure I,ve missed out something but you get the gist. I have never met such corruption in 50yrs of living in Uk and thankfully I am not as bitter as you seem to be. Bet you never experienced what we have to make you so negative.

Your right there Pauline, i too have never met as many bandito's, as ive met in Spain, including So!icitors, Banks, and Service suppliers.

And I'd like a pound for everyone who told me "they'd never go back to the UK, who are not there any more, especially when one partner dies, and they are there alone !
