In regards to making a WILL

Hi

Can anyone advise me of a good local solicitor to do a WILL for me.

I have been quoted €300

Is this a fair price?

Lots of previous posts on this. Solicitors will simply refer you to a notary and will also charge their fee for doing so. No, 300 euro is way too much.  A notary will have several templates for wills which they will alter to suit and will probably charge around 100 euro or less.

Thy Will Be Done is a member on here and many have been to them (situated in Benijofar but does a lot for you by email and online) who will ensure your will is done to your requirements regarding the country rules you want it to be handled under. Also around the price of the notary as well so avoid solicitors at all costs as they will charge you far more than a will company or notary will do.

Thy Will be Done also has a website to look at but a notary will have it all in hand as well plus both options will give you a copy in Spanish (as required by law) and English for your own records.

We paid exactly the same at a notary in Algorfa.

Our fee for a Spanish Will is between 99€ and 159€ including iva depending upon what is required to be included, so I would venture that 300€ does indeed seem very high, unless of course, this was for 2 Wills.

It's cheaper to go to the notary in Campello ! Under €100 for a will. We did ! You go one week tell them who you want to leave everything to. Then go the next week check it and sign it. They register it. We used Notario de Campello, Carrer San Bartolome 33 First floor. 965 63 67 70. I'd just pop in there and ask for a quote. It's opposite the water feature on the main street in Campello. If you want it valid in UK you have to put valid under UK law. The notary will advise.

Hi again LJBELLA,

Consideration of course should always be given to the cost of making a Will.

There are however, a number of other very important considerations to also take into account such as:

What happens after your death? - do you wish to use an usufructo clause to protect the half of the 1st to die from being lost if the survivor remarries or goes into care?

Do your beneficiaries speak Spanish? - is it best to elect and English and Spanish speaking Executor to liaise with the beneficiaries in English and the Spanish authorities in Spanish?

Would you prefer to have the UK beneficiaries helped in the UK to obtain their NIE numbers (which they will need in order to inherit any Spanish assets) by a company that has offices in both Spain and the UK?

Would you prefer to name a legal executor to act for you in advance within the Will to ensure the beneficiaries know who to contact when the time comes and have that legal representative stipulate in advance what their probate fees will be rather than the beneficiaries themselves have to travel to Spain and seek out an abogado to act for them, give that abogado Power of Attorney to act for them and then pay the fees of the abogado for their work which will not be known in advance, only when they are engaged?

In addition, if stepchildren are involved, they will pay considerably higher inheritance tax than natural born children and consideration should also be given to ''adopting'' them in advance in Spain to mitigate this (see here: https://thywill.es/stepchildren-and-inheritance-tax).

And finally, one should also bear in mind that to be 100% correct, the Law of any British expat/immigrant used in their Spanish Will should clearly state The Law of England and Wales, Scotland, Northern Ireland, The isle of Man, or the Law of Jersey and Guernsey as neither UK law or British Law exist as legal entities.

It is crucial to know exactly what your options are and everything that must be considered for accuracy and peace of mind in advance because, like a life insurance policy, it is only when it is required to be used that its true ''value'' will be realised.

Google reviews are by the way, an excellent tool for establishing the experiences of any firm's previous and existing clients in the first instance.
