TIE required if married to a Spaniard?

Have been reading Jim’s Guide and wish I’d known about it years ago when my Spanish husband and I first moved to Spain (he’d lived in Sweden most of his life so was, like me, unfamiliar with procedures here). The Guide would have avoided many stressful situations and sleepless nights! I’m wondering if Jim could advise on my situation as I have an NIE but I’m unsure if I should go ahead with a TIE or try for a Spanish passport, if that’s possible? My husband has a Spanish NID so I’m wondering if this makes my situation different? Thanks Jim and others on this Forum.

Your husband will have a DNI - Documento Nacional de Identidad.

I'll have to guess, as I don't have time to research the detail - I'm not aware of any special treatment for the spouse of a Spaniard, but that may just be because I've not come across it.

If you've been here ten years, then you could apply for Spanish citizenship, then a Spanish passport and DNI.

If you can't or don't want to go that route, then you need to apply for a TIE.

If you're in the Spanish health system because of your husband's entitlement, then you're covered as regards the residencia healthcare requirement. If not, you'd need PHI or be paying for the Convenio Especial.

If your personal finances are sufficient, then again that isn't a problem. If not, tell hubby that he's got to come up with some money if he doesn't want you deported! Alternatively, you could presumably apply as a family member of an EU citizen.

As I said, I'm guessing. As you're presumably fluent in Spanish, I think the safest thing to do would be to pop into Elche cop shop and ask them. They might tell you to go to Alicante, but it's obviously easier to ask locally in the first place.
