Hi all,

We have sold our home in the UK and plan to move to Spain asap. Our daughter is 15 and we were going to wait until she takes her exams next June/July but would love to move to Spain this year if there was some way our daughter could continue her studies in Spain and still take her exams next year, even if flying back to UK to take them.

Does anyone have any experience of this situation or can recommend further advice... 

So looking forward to a new life in Spain and meeting all you nice folks!

Hi Paul, 

I can't give you any advice re education but beware if moving so soon after selling your Uk home. If you move this year when there,s more than 6mnths left of the year(183 days to be precise) you will be expected to pay CGT on the profits you made at 19% to Spain as you will have become a fiscal resident, whether you have gained residencia or not. If you move over afterJuly this won't apply as you won't have been in Spain this year more than 183 days.Spain tax year Jan-Dec. If sold before 2019, no problem, your tax bill for this year would be declared next year (1 yr behind) so would need to allow for this then. Wise to take tax advise in this situation.

Hi Pauline,

This came as a shock! No one has mentioned this to me in all my enquiries, so thank you very much for your comments... We have accepted an offer on our house but will not likely complete until July. We are planning to rent locally here in the UK until next June after daughters exams but would like to purchase our new property in Spain as soon as the right one becomes available this year.

What do you consider will be the tax implications on the above. Can you kindly recommend a source of further advice regarding Spanish tax on moving to Spain.

Hi Paul,

I,m so glad I replied if you were not aware of it, sometimes you have read information but in the euphoria of proposed plans, you can forget important details. Firstly, renting or buying after 90 days in Spain you must sign on the "strangers" register at a police station this is similar to applying for residencia, and after 183 days you then become a Spanish tax resident. I wont go into more details myself, only because there are fantastic information blogs by Jim Taylor on this forum called "Jim's Guides" and what he doesnt know and inform isn't worth knowing. They cover every aspect to living legally in Spain. If your house completes earlier than July then either rent short stay in Uk or stay with relatives. Work out the 183 days backwards from Dec 31st and just dont move before that. You wont have to declare your tax return until 2020 for 2019 if you had stayed more than the 183days but my posting was to remember to keep money back for paying the CGT the next year. Better still don't put yourself in that situation! Search Jims Guides and you will be better informed for your move. I have joined the CAB website in Spain too for more guidance. Citizensadvice.org.(I think) or google CAB.es and that would find it, especially with all the uncertainty regarding Brexit. You may need to gain more information regarding the requirements to obtain residencia as at present (UK still in EU) the requirements are a lot less financially, than when we have left the EU. This should be your priority to research at this uncertain time. Good luck for whenever it happens.
