Hi My Name David I have Squatters living in my apartment. Went to the Guardia civil and reported it they told me I would hear from the court that was two years a go. I'm still paying suma tax and none resident tax. Not sure what to do can anyone help or give advice thanks

Get a good lawyer who specialises in that but it could take several years and expense to come to a conclusion. If the squatters have kids that will cause even more delays.

I second Steve's advice to get a good lawyer experienced in evictions. I would do this as soon as possible.

Are you still paying your electricity & water bills, or building up debts? It's possible that these services have been cut off if no payment has been received. Your squatters may have illegally reconnected these services.

Are these squatters tenants who've stopped paying rent? or people who have broken in?

Your post is a bit unclear. You went to the Policia and made a Denuncia presumably. The Policia won't do anything if the squatters have been in the apartment for over 48hrs. Why they should say you will hear from the Courts puzzles me. It is up to you to start the eviction proceedings through the Courts not the Policia.  If it is an apartment it is presumably in a block with a Community of Owners and an Administrator. Have you reported it to the Administrator as laws have changed a little in Spain regarding squatters and they can be debarred from using the Community facilities and the Community can take an active part in evicting them if they are causing problems like anti-social behaviour or abusing the Community property etc. You can also employ a company to negotiate the eviction of the squatters from your property. At a cost of course.

Another suggestion is to introduce yourself and your family to your neighbours.  Find a neighbour you trust with your contact number should they find anything suspicious while your are gone (WhatsApp is free).  Also, hire a property management service and let your neighbour know this with the name of the company.  Someone will check your unit or house as often as you think is required. They will "air out" your unit or house, water your plants, flush all the toilets, look after your pool, etc.  They are not as expensive as you think.

If you rent out your property while you're gone, again hire a property management service to deal with your unit.
