We have been refused our residency for not having a private health policy, my husband retired in 2018, 18 months before Brexit foolishly we carried on using our HIC cards to get access to medical care, we only used them about 10 times, we now have our S1 certificates. But we need to prove we were eligible for care through the NHS in the U.K. we haven’t received any hospital care, anyone got any ideas ????

If you are retired and receiving UK government pension you can use the S1 healthcare scheme to gain full Spanish healthcare. 

Your S1 healthcare forms need to be pre-registered with the Spanish Healthcare office (INSS) local to where you intend on living. When they are pre-registered you can use them for your residency application and to get full healthcare for both of you (provided that both yours and your spouse names are on the forms).

If you failed to register your S1 in 2018 when you reached state pension age and you both had no private health cover, then you were not residing legally in Spain and not entitled to Spanish healthcare.

I would think that your only way forward is to apply for a NLV at the Spanish consulate nearest to your home in the UK (Edinburgh, Manchester or London). Once your application is approved you'll need to travel to Spain to complete your residency application within 1 month.

You can both use your S1s to prove healthcare cover for your application and register these online. However, the funding requirement has increased significantly since you last applied.

The OP was talking about getting an NLV back in Dec.

I'm not sure but I suspect the O/P is referring to an application made under the withdrawal agreement, which required you to prove that you were legally resident in Spain prior to Dec' 2020. As part of the proof you were required to have healthcare and be signed on the padron. 

Apologies if I'm wrong.

If in fact under the WA then without proof of health care, either private or by S1, then I think it's a hopeless quest.

S1's cannot be issued retrospectively so there is no possibility of getting one which would prove cover for the time you spent here irregularly between 2018 and Dec 31st 2020.

Assuming you can meet the financial qualifications, €37k for a couple now I believe, the NLV route is now your only option.
