Hi hope everyone had the best Christmas possible under current restrictions. Has anyone in Monte y Mar had a request from the presidents admin regarding the new water pipes that need to be installed? At a cost to each home owner of €100 per month -for 6 months? The email I received says it’s due to the insurance company no longer can insure the water company for the ongoing leaks breakdowns etc! I’m very concerned about this! Thanks for reading. 🤔

Sorry, I can't help with your specific query, but it seems logical that other owners on your urb would have received similar requests.  

However, in accordance with Horizontal Property Law, this issue should have been tabled at a meeting of the Community of Owners and included in the community's annual budget, which should also have been tabled at a meeting of the community's owners.  I think the email that you've received, stating that "it’s due to the insurance company can no longer insure the water company for the ongoing leaks, breakdowns, etc." suggests that this has been an ongoing issue; so again, I would expect the owners to have been made aware of the issue before it got to this stage.  I mention this because your post sounds like the demand for further maintenance fees is a surprise to you?  

You should also check your community's rules - they may give your administrators the right to impose these fees without going through the usual process.  None of this will necessarily mean that you're not liable for the additional fees, but it may prevent you being caught out in the  future.

I hope you can get it resolved satisfactorily.

Thanks for ur response Kim. I’m very new to all of this as only bought my holiday home earlier this year. Yes the email was totally out of the blue-I received it 23rd December! Due to current restrictions/circumstances I haven’t been able to get out to Spain as much as I wanted, and I’ve never been able to attend any meetings or meet the president etc! They’re asking for a Yes/No answer by January 4th! I’ve tried phoning but I’m unable to get through....they’re likely closed for the holidays!

Presumably, they're asking owners for their agreement by 4 January, so that they can include the extra fees in a revised budget for the new year?  In your position, I think I'd respond to their email without delay, asking for a copy of the community's current (2020) annual budget, along with a copy of the quotation for the remedial works to the water installation, and whether they're asking all owners, or only specific owners, for the additional fees.  I'd also tell them that I can't confirm my agreement before 4 January, without first seeing the requested documentation - that puts the onus on them to provide the information in a timely manner and prevents them suggesting your agreement was implied by a failure to respond to their email.

Apologies if I sound cynical - some communities are run very efficiently, but others are not, and if you've only received their email today, wanting a response within 1 week, that suggests to me that your administrators may fall into the latter group  ;o)

Hi Kim I spoke with u just over a month ago....I took ur advice & sent an email to our urbanisation admin regarding the water works etc! This is my update for u ....so far I’ve heard nothing from them not even a reply to my email so I’m now keeping my fingers crossed 🤞 I’ll keep u updated if i hear anything

Thanks Kim! I don’t know but I’m sure most people in the community will object to this! Hopefully will have some news soon.... it’s difficult finding out anything when we’re in the U.K. Hoping that the many Spanish residents will get it sorted out.
