Guest problem on holiday let

Hi, does anyone know what the legal procedure is if you had let out your property to guests and they refused to leave or had keys cut and were using the property without permission. Wondering what the legalities would be and how best to deal? Has any been unfortunate enough to have experienced this?

Sounds like you have a squatter problem. Contact the police immediately otherwise it could take years to get them out.

Do you know if squatters have rights in Spain and do the police take this type of thing seriously. Not a problem for me but just wanting some idea of what to do quickly if it happened.

I understand that if the squatters are not evicted within hours they have many rights and it takes court proceedings to evict them. I don't think the police can do anything until the court decides.

If it is a short term holiday let you should have a legal Tourist Licence for a start.

You should also have a signed contract with the guests showing the exact start and end date of the rental, monies paid, number of guests etc. This is a legally binding contract. If they refuse to leave, call the police and produce the contract.

However, in our experience it is unheard of that short term holiday guests don't leave.

As a legal let with a Tourist License you will have the guest's passport details (registered with the authorities when they arrived), their home address and the signed contract with arrival and departure dates.  I don't think squatters would fly to another country, pay upfront key deposit and rental plus provide all those personal details.  As they would also be squatting in a foreign country they would obviously become illegal migrants over time.  They would also know that our keyholders would be arriving to collect the keys, (and clean the property ready for the next guests), at the pre-agreed time on departure day.

Thanks for that but alarm bells were ringing as the enquiry was from a family living approx 1/2 an hour away so seems a bit strange!
