Good evening,

I'm looking to rent an apartment from 12/10 for about 3 months in Guardamar del Segura. I have been contacted estate agents and looked of course on all the property websites. There are some private owners offering their apartments on the websites, but I'm a little bit anxious contacting them, because I have had already 3 scams.

Does somebody may recommend a private landlord I could contact?

If you are coming for an extended holiday the unfortunately no one can legally offer you a holiday let of more than 10 continuous days in one property. If you are coming to work or relocating then you are looking for a short term or seasonal contract. 

For holiday lets only, (now max 10 day stays) then checking the Tourist License number is essential to protect yourself against being scammed.

Seasonal lets do not require a License but are not intended for holiday purposes.

Valencia region only, all provinces. Decree was issued about 6 weeks ago with immediate effect for all new bookings.

Yes, it's new. It's really put a damper on our visits. Love Spain but have decided to go elsewhere until they change the laws again.

It doesn't make sense to me.What is the purpose? 

Maybe they think it would put people off coming on holidays, so there would be more apartments available to rent for the local people?!

I am sure the landlords will find a way around the new law.

Bear in mind it is the hotel lobby that are behind this. Only the hotel lobbies, not the holiday home owners' associations, were consulted.

The official stance is that by restricting holiday lets to 10 days owners will switch to either long term letting or to seasonal lets for seasonal workers - the irony being that without the tourists there won't be so many seasonal jobs!  Most holiday let owners are letting their own second home, so of course they won't switch to long term letting.

Town Halls have had complete control over how many tourist licenses are permitted in their area since June 2018, so if they have permitted too many then they, not legal owners, need to take responsibility. The Town Halls also grant planning permission for all the new blocks of small but expensive tourist apartments instead of affordable housing.

Anyone seeking to circumnavigate the new regs will be breaking the law and could be heavily fined.

In reality, this decree will probably result in more, not less, illegal letting.

While I have some sympathy with the idea that it is the hotel lobby behind it - the hotel lobby aren't in government.

So it is the "fault" of government for what many see as the crappy legislation. I only mention it as I'd rather the blame be pointed at those responsible for the change as opposed to those who might have campaigned for such a change even if they don't have any legislative power.

I suspect what we will see is an increased focus on tourist let apartments/flats as opposed to houses - that seems to be where lots of the ire seems to be (across Spain not just in the Costa Blanca). If a property wouldn't be able to get a tourist licence now (lets say due to the size of rooms etc) then it is ripe for getting struck off the existing register simply because it got its licence before the regulations were tightened.

But as I've said elsewhere, that has nothing to do with the length of a let - 10 days, 89 days. Who cares. If anything, I'd have suspected longer lets would be preferred by fellow home owners in an urbanisation as it's less disruptive and I'd imagine longer term tourists are generally more respectful etc of their surroundings.

Thankyou so much for posting this. It is very important both for residents inviting friends or holidaymakers making an illegal booking without knowing.  E.g. AirBnb are taking 3 week bookings right now.
