We became residants last November I have recently been emailing some companies to do my tax return as we stay longer than 6 months of the year in Spain. My solicitor will do the tax return for me & my wife for €120 which seems fairly competeive compared with other quotes, however they are asking 150€ each to register us as fiscal residents which he says has to be done at Elche tax office & we need 7 months of bank statements to prove this. No one else has mentioned this. Is what he is telling me correct

Yes, our accountant had to take 6 months bank statements, a Padron and our house deeds to Orihuela to apply for the Fiscal Residencia. When she did mine alone, it cost me 60€

To do a tax return, you need to be registered with Agencia Tributaria, and this doesn't cost anything:

Once your first tax return has been submitted, you can get a fiscal residency certificate, again for free, for submission to the Inland Revenue:

Jim, we have now had 2 years tax returns filed online. My accountant applied for my Fiscal the first year because I wanted a tax refund from the UK. Alan did not have any tax to claim back so we didn't bother with a certificate for him. However, in the summer, following my request, she applied online for his. It never came, so she applied again and they said he was not a Fiscal Resident and they wanted all the documents I mentioned in my previous post to take to Orihuela. I gave them to her last week. Alan is below the threshold for Spanish Income tax, so hasn't paid anything.  Whether that had any bearing I don't know.

Hi Sheila, two points.

If Alan has filed a tax return, even if he had no tax to pay, then there's no problem. If he didn't file a return, then you haven't read my guides!

Once a return has been filed, it's easy to download a fiscal residency certificate, without the need for any additional paperwork.

Hi Jim, the accountant filed our returns and the first year Alan received a 3€ refund from the Spanish. Perhaps the office in Orihuela are just being awkward, the mind boggles. I have learnt to just go with the flow now.

It's not the office being awkward, Sheila, as it's all computerised. I'd suggest it's a problem with whoever you asked to do it. I admit that actually going to the tax office could present a problem, but if you've officially appointed a fiscal representative, then that person can do it all online, as the computer system would recognise that person as acting on your behalf.

Yes she did that, but a letter came back saying he was not a fiscal resident, so they wanted all the documents. I couldn't argue with that because they asked for the same for me. By the way, last week I went to Playa Flamenca town hall to get Alan's Padron. You don't even have to make an appointment now, they said come back tomorrow and pick it up. We went back the next day and was told 'he is not on the padron' to which I replied 'Oh yes he is'. After two or three of these exchanges she went into the padrons office and came out with the stamped form and said 'sorry'. It does make life interesting though.
