If anyone could give me some clarity on the following please. 

We are in the process of applying for      Residentia. The lawyer is pulling together paperwork etc and included in this is a padron. My assumption is that until we/ if we get our residentia then we are still classed as tourists and can still drive on a U.K. licence. Any help much appreciated.

You can call it semantics but tourists you are not, you are 3rd country immigrants with visas engaged in the process of formally applying for residency which is what the visa grants you permission to do.

Offhand I do not recall whether it's from the date of the visa issue, date of arrival, or acquiring your residency (TIE) but whichever it is you can use a UK licence for 6 months after which it becomes invalid.

Hi Paul,

Darro is correct.  While you need a 'Certificado de Empadronamiento' in support of your residency application, it's illegal for someone to register on the Padrón if they are not applying for residency - by doing so, they are effectively declaring themselves as living in Spain.  

This is a very important point for all non-residents who, encouraged by their Town Halls, registered on the Padrón even though they don't live here and never plan to do so (because the Town Halls receive funding from Central government per head of population registered).  If stopped by the police, driving a UK registered car, they could have their car impounded.  Advice from the British Embassy is that any non-residents currently registered on the Padrón, who are not applying for residency, should de-register.

Our application is in process hence we had to produce a padron as part of the application pack.
