Darro is correct. While you need a 'Certificado de Empadronamiento' in support of your residency application, it's illegal for someone to register on the Padrón if they are not applying for residency - by doing so, they are effectively declaring themselves as living in Spain.
This is a very important point for all non-residents who, encouraged by their Town Halls, registered on the Padrón even though they don't live here and never plan to do so (because the Town Halls receive funding from Central government per head of population registered). If stopped by the police, driving a UK registered car, they could have their car impounded. Advice from the British Embassy is that any non-residents currently registered on the Padrón, who are not applying for residency, should de-register.
