Can someone help me !

I became a resident in 2007 . I left Spain 2011 I informed the bank and they converted my account to non resident. I sold my villa 2012.i returned back to uk , where I am now.I now have been informed by a someone I might be still classed as resident as I did not know I suppose to de register at the police station(naivety).

I have since bought again Spain 2 years ago and nearing pension age and have decided to move to Spain permanently

The new Brexit rules state to get residency now you have to get a non lucrative visa first then apply for TIE..

The question is am I still a Spanish resident?

Any help appreciated. I have asked a Spanish solicitor firm and not had a reply.

Hi there 

Yes I have a copy of the residencia permit

I have emailed to a Spanish company and they are going to a local police station and check if I am still registered and they said they would apply for the TiE for me.

I did read that after 183 days you are classed as a non residence , but could be still registered as resident. So tax wise I’ve paid tax NI since leaving and due my full state pension in a few months.

Thanks for your reply you give me a glimmer of hope, as I’m not looking forward to applying from scratch visa etc and financially not cheap

Hi Martin,

If you leave Spain for more than 6 months in any one of the first 5 years of your legal residency in Spain, you void that residency.  However, as you've already contacted a professional who's undertaken to check your status with the National Police for you, it makes sense to sit tight and see what they say.  Good luck!
