I am new to Javea how do I apply for residency

Hi 

I am looking at moving to Javea I am a yo citizen but have Dutch residency 

How do I apply for residency 

Does this only allow me to stay for 90’days within the 180 days ? 

How can I stay permanently 

Would it help to be employed by a Spanish company or do I still need a visa because I am originally a British Citizen can anybody help

You should have applied for Spanish residency whilst you were still in the UK. As a British national you will have to apply to the Spanish embassy in the UK. They will advise you about visas and the income and healthcare requirements. 

You will need to prove that you have an income of around €24,000 plus another €6,250 for your spouse per annum. 

You will need full healthcare paid for a full year.

I live in the Netherlands the company I am working for is Dutch 

I thought you could apply for residency within the 3months after arriving in Spain ?

Yes you need to apply for residency within the first 90 days of arriving in Spain.

Hi Angela,

Your status as a Dutch resident makes no difference in this instance, because of your UK citizenship.  For example, I'm a British citizen and a Spanish resident: I can live permanently in Spain, but I still have to comply with the Schengen rule '90 days in a rolling 180 days' when I travel to other European countries, because my UK citizenship makes me a Third Country National since 1 January 2021.

Also, if you apply for Spanish residency, you will become liable for income tax here, so if you intend to continue working for a Dutch company, you need to check what taxation agreements may exist between the two countries and what impact your citizenship status as a TCN may have on your tax liability in Spain.  If you obtain Spanish residency and spend less than 183 days in the country, you lose your residency.

Hi Kimmy

Just wondering with no borders within Schengen.. how would anyone know whether you spend 90 days or more in any 180 day period in another country?

Doesn't your Spanish residency give you Schengen type rights whether a UK citizen or not?

I'm intrigued..

Hi Bulkbiker,

While a UK citizen who has Spanish residency enjoys visa-free travel to Schengen countries, we don't have the right to exceed the '90 days in 180 days'  Schengen rule (unless we apply for a visa or work permit relevant to the country where we want to stay longer than 90 days).  How that will be policed at EU country borders, before the introduction of ETIAS in 2022, I have no idea - but if you decide to test it, do let us know how you get on!  ;o)
