We used Babelia (funded by UK Gov to help Brits with their applications, for free).  Great service.  See below,...they are looking for input from anyone who was turned down:

In order for Asociación Babelia to raise with the Extranjería Office as well as with the British Government the issue of residency applications that have been denied to UK nationals, we need your help to disseminate our Survey on Residency Rejection for UK Nationals in Spain.

Be sure you know to whom you disclose your personal data. If your application is rejected you have 2 weeks to appeal by means of a so called "recurso de reposicion" fending off aleged reasons of denial.

Many thanks for sharing.

I've heard of UK citizens being denied residency because, although they registered online prior to 31 December 2020, delays in obtaining Padron appointments have resulted in Padron certificates being dated after 1January 2021 and this is being used as an excuse to reject residency.  Similarly, people who have private health insurance dated after 1 January 2021.  This is illegal, according to the Withdrawal Agreement, but trying to have that debate with an immigration official may be another matter!

Hello Kimmy

I've just had my residency rejected (by Valencia) on the very grounds that you mention regarding health cover not beginning on 1st Jan.

I am fully ok with all paperwork and meet all criteria except that my private health cover did not start until later in the year and this is why they have rejected me. I now need to appeal. Is there anywhere specific in the Withdrawal Agreement that I can point to when I appeal?

Any help would be much appreciated as after two rejctions I am losing faith in the process.

Does your Padron certificate pre-date 1 January 2021?  I think you need to speak to someone who is specifically able to support UK citizens making applications under the Withdrawal Agreement rules - have you contacted Babelia?

Yes my padron is from autumn 2020. I contacted Babelia after first rejection and they were great but my understanding is that as of the start of this year they are no longer being funded to help out by UK Gov (as presumably all these issues have magically been resolved!).

So any alternative sources of support would be greatly appreciated. I would like to get my appeal in within days. Not being able to travel abroad in the coming months is going to cost me dearly!

Can Babelia continue to assist you, if you pay for their services?  I ask because any other gestor will charge, so it would seem sensible to pursue an appeal with the organisation that already knows all the background to your case.

You say you´ve had "two rejections" - how so?  I will ask the gestor who I know works with Alicante´s foreigners office whether there is specific information or advice that has been proven to ´unlock´ this type of case.
