morning,

i've had a look at Jims guide which is very useful.

Just a little clarity on my part needed if possible on a couple of things.

i want to come to Javea for a 5 month holiday from Decemeber to get away from the UK weather, stopping in a winter let apartment.

as i'm stopping less than 183 days/6 months and driving over in my UK registered car i don't need to re-register it in spain, is this correct ?

It looks like i need to become a resident as i'm stopping more than 3 months . is this correct ?

What happens about tax, i will be still be receiving an income in the Uk from residential properties i own .i have savings in my accont to cover the 5 months rental and to support us both.

i have my NIE number already, and was going to open a Spanish bank account to make paying the rent/bills etc easier(i presume).

it's just seems a lot of hastle becoming a resident for just a 5 month period, is there any other way of getting "registered" or a visa of some sort.

To add to what Ray has said, your UK car will be OK, and you won't become fiscally resident if you stay for less than 183 days, so tax won't affect you.

Legally, you should apply for residency if your stay is more than 90 days, but if Brexit hasn't kicked in when you come then the duration of your stay won't be monitored, so you'd get away with not registering. If there's a hard Brexit with no transition period then your stay will be monitored and you'd have to comply with the regulations in order to avoid problems - and those problems might include a restriction on returning to Spain at a later date.

The only other way to be legal is to apply for a long-stay visa, and I suggest you avoid that if possible.

If Brexit goes 'no deal' and turns nasty then it's possible you might need two different IDP's (International Driving Permits), a 1968 convention for France and a 1949 convention for Spain.
