Now that Jim has left the forum can anyone help with the procedure for obtaining residence tax payers certificate for a UK tax refund. It has been suggested a lawyer would be able to help but we would rather have a go ourselves. Any help would be much appreciated. Thanks .

I don't have the answer to your exact question, but (if I understand your point correctly) we are in the same process.

Having paid our income tax in Spain for Jan-Dec 2019 (we paid most in June and a bit more is due in November), we have each filled in "Form Spain-Individual"   ... HMR&C United Kingdom/Spain Double Taxation Convention (SI 1976 Number 1919).

There are two copies to fill in ... one in Spanish & one in English.

They both go to the Spanish tax authorities. Once the Spanish authorities are happy that all is in order, the English version one is sent to the UK tax authorities. 

That is all I can tell you at the moment. We filled in our forms and gave them to our gestor 2 or 3 weeks ago.  

We await news of our UK tax refund with baited breath.

Kelvin1960 thank you that's the same process and we have been told we have to go to Alicante to get the forms and they have only just recently re-opened. We are not using a gesture we are trying to do it ourselves. As a matter of interest would you mind saying how much you paid for that service. We might then consider the costs involved. Thanks.

We paid our gestor back in February for the complete process - Modelo 720, then income tax submission, and now UK tax reclaim.

From memory, the gestor cost was 250 Euros for the two of us.

My experience was slightly different Kelvin, not saying you are wrong by the way! My Gestor filed my first tax return and after paying my tax she obtained a tax certificate for me from AEAT. I cant post that certificate here but it confirms my Spanish taxpaying status.

I completed the double tax form that I downloaded from HMRC, completed it in English and sent it to HMRC with the certificate from the Spanish tax office, plus other ID which the form required (to be honest I can't remember what they asked for now but I think one was a notarized copy of my passport)

Anyways.... I heard nothing from HMRC for ages (I was hoping they would write to me with confirmation but they didn't) Nor did they put a message on my HMRC log in message box.

However.... a few months later HMRC wrote to me in Spain about a different matter and in that letter they referred to the fact that I was now outwith the UK tax system so my process had obviously been ok.

Not sure where it gets us but there you are!

I think that highlights the lack of consistency here in Spain.

I have noticed it before .... people post their experiences, and then others describe how it worked differently for them.

The important question ... did you get your UK tax back ?

We are already looking at 22 months of UK tax refund.

In a word, yes I did, but I'd already had 2 large refunds from HMRC and they sent a calculation that they'd slightly overpaid me, which when I examined the calculation I couldn't really argue with. So I stumped up and I think (hope!) that's last the last I hear of them 😄

Interesting guys  ut not a complete answer for us. Eatingout can you tell us how you got your tax certificate for AEAT whatever that abbreviation stands for. Remember we hoping not to have to use a Gestor. Thanks

I have no idea how to do it yourself. It may be possible.

AEAT is the Spanish equivalent of HMRC. Sometimes referred to as the Agencia Tributaria. Slang sometimes used is Hacienda 

You can't get a tax certificate without first filing a tax return. If you are able to file your own tax return you might be able to navigate your way to getting the Certificate. 

However, I used a Gestor to file my tax return - cost about 80€ if I recall - and the Gestor got my Certificate from the Spanish tax offices AEAT without further charge.
