Hi folks, 

Just a heads up - there's a lot of focus on the requirement to have a current tourist licence (not a new requirement, but being more rigously enforced now.). The penalties for both property owners and advertisers are very severe if no licence is in place. Many people are trying to get around the issue by advertising tourist rentals with the caveat "tourist licence in process" BUT please beware that there are strict room size requirements for licences to be granted. Most people are having difficulty with the minimum room size for bathrooms and licences are being refused if rooms are too small. A lot of people aren't aware of this and think the application process is simply more bureaucracy. This will affect people who are looking to buy small properties specifically to rent out to tourists - don't end up buying an investment that ends up not being fit for purpose. Triple check EVERYTHING!

I am currently looking for potential holiday lets on the campsites, this is another piece of learning for me, thanks. 

What exactly is a tourist licence and to what do they apply, any other information would be helpful.

Hi Lawrence, I don't know all the details - I'm on a steep learning curve myself and only found out about it when I started researching on the Internet. CAB is an invaluable resource. I've had agents telling me it's nothing to worry about and it can be ignored - sadly, this is just not true. It's vital to stay legal.

Excellent advice, useful information. There are so many requirements (beyond getting licenced) that it's very off-putting to anyone thinking of getting into the tourist rental business. My point is that applying for the licence is no guarantee that it will be granted - minimum room sizes will mean a lot of licences are getting turned down now, so beware anyone who says it's just a paper exercise.

Probably easier to let out long term. No licence required. The negative is that you can't use the property until the lease ends - legally min three years shortly to be upped to five. Some years ago I did the sums - long term letting is more rewarding and much less hassle.

Tend to agree with the long term let being a better bet, though not as lucrative. You hear all sorts of horror stories about tenants' rights, especially if there are children in the house. I know some people try to let for 11 months in the belief that this gives the landlord protection but I gather that's a myth. Nothing is easy, is it?

Is there somewhere that actually states minimum room sizes anywhere, or does it differ from region to region?

I found the minimum room sizes online, sorry I don't have the website details to hand. A guick Google search will turn them up.

The same rules apply to all of the Valencian Community.

I've never studied the legislation in detail, so feel free to correct me. However, the original DECRETO 75-2015 spelled out minimum sizes. For example, the principal bedroom must be at least 10 square metres, and the bathroom must be at least 4.5 square metres.

It's the bathrooms that seem to be causing the most problems - need to be around 8.5 feet by 6 feet to qualify and the majority of the smaller properties in La Marina miss it by just a few inches. I've heard of licences being refused because of thus, thus rendering them unsuitable for tourist lets.
