Is La Marina urb classed as "residential"?

Hi folks, 

I'm in the process of researching the potential of buying a property in the urb specifically for tourist rental. I've read up on the regulations regarding tourist licences and am aware of licences being refused on the grounds of minimum room sizes. However, a new spanner has been thrown in the works as I've just been informed that the Town Hall is now refusing all tourist licences on the grounds that the area is classed as residential, irrespective of any other regulations such as room sizes. Does anybody have any knowledge of this? I'm aware of the fines for illegal lets and I'm anxious to avoid a very expensive mistake! Many thanks.

Hi when we bought on the Urb we were told it was residential.  I found this on

I´ve found this for you. I haven´t read it myself so can offer no wisdom but as it is issued by Valencia, I can only hope it answers your question.

Spain is not the only country clamping down on these rentals due to locals being forced out with increased rents, the noise, tax avoidance, the list goes on. It´s happening in the UK with restrictions on second homers in some tourist areas already.
I can only think how I would like it if I lived next door to one. It is not usual, in a residential area, for taxis to be turning up at all hours, suitcases being wheeled in and out, the "I´m on me holidays" mentality with late night noise and alcohol related nuisance.
My personal opinion is that a good few of such properties that have operated without a licence, possibly tax free, will be going up for sale, saturating a market already over supplied with such properties.

Cheryl ...couldn’t agree more with what you’ve said. I welcome wholeheartedly the tougher stance on holiday rentals. I’m not a full time resident but I have never rented out my place nor will I ever consider it.

To save you lots of hassle and searching you could use www.spanishpropertyteam.com as they will have all the legal knowledge and can advise on areas where it may be better for rentals so as not to annoy home owners.

May be easier?

Thanks for this, enormously helpful. I gather the regulations around illegal tourist lets, whilst not new, are being much more rigorously enforced now. I know there's been a thriving business in tourist lets and lots are advertised nowadays with the proviso "tourist licence in process" - if these licences aren't going to be granted there are huge fines for ir both the owner and the advertiser. Scary!!!!!

Thanks for this. I totally understand and sympathise with people who have to endure the tourists, some but not all, who have no regard for neighbours and I absolutely deplore anyone avoiding tax. I bought a little place recently and so many people have told me to buy a couple of cheapies and rent out to tourists. I'm doing my due diligence now and hence the queries. Seems like a minefield and I think you're right about a lot of people in the past have got away with illegal actions but those days are going. I just want to stay legal and avoid any expensive mistakes. I agree about the effect this will have on the market at the lower end and it's sad for any genuine owners who will be trying to sell in an already saturated market.

Thank you for posting this information. It is invaluable. We have owners on our urbanisation who rent their properties out to all and sundry. They don’t care about the other residents, especially the ones that live by the pool. When residents complain about their rowdy guests abusing the rules, their immediate reply is “you shouldn’t have bought by the pool then” urgh!! They love waving their tourist licence around, and boasting about being ‘legal’. Ha, legal yeah, but maybe not for much longer. Happy days.
