How do I overtake a cyclist on a 2 way road under the new driving restrictions? The speed limit is 20kph now but the rules say I have to reduce my speed by 20kph and leave a 1.5m gap when overtaking.

Someone please correct me if I'm wrong but I think the new rules say that you can no longer increase your speed by 20kph to overtake another road user.

If the cyclist is doing the speed limit you can't overtake.

I'm staying home until it sorts itself out.  :)

Hi Myra,

That's correct - you used to be able to exceed the speed limit by up to 20 kph in order to overtake a vehicle driving slower than the designated speed limit, but that's been removed from the new rules.  As Yogited has pointed out, if you're behind a group of cycles, you're unlikely to be able to overtake, unless they're doing 1 kph!

I also asked my Spanish teacher today about the road signs not having been changed yet and she said it's the road user's responsibility to know the current regulations, so using out of date road signs as an excuse with Trafico won't be accepted as mitigation 😏

Kind regards,

Kim

However... the town halls can override the national speed limits by putting up signs if they see fit. So now I wonder if we have to know which are new signs put up and which are left over from before the new rules. :)

I think I'll be staying home for quite a while.

I am so fed up with cyclists being given priority over other road users, eg car drivers. As long as we give them adequate clearance when overtaking and, of course, as long as they ride single file instead of spreading themselves over the entire road surface there should be no problems. But! With battery assisted cycles capable of going at 20km per hour can someone explain to me just how on earth we are suppose3d to get past gaggles of cycles doing 20kms? Do we have to sit behind for as long as they wish to block the road in front of us or what? Time they paid towards all these cycle lanes (WHICH A LOT DO NOT USE) too. They are only constructed for bicycles after all.

Before you say "get a cycle" I have spinal injuries and so cannot ride one. If I could I would have more respect for other road users.

Thanks for your replies. Nobody has given me an answer yet so maybe there isn't one? If that is the case where do we go from here? By the way I did not ask this question for people to have a go at cyclist. If you wish to do that please open your own topic. This is not a joke. This topic is a serious attempt to correct an obvious flaw in the new traffic laws. Anyway I thank you for your consideration and I will look to ask the question somewhere else.

and I am taking it very seriously. The last thing any of us need is to find ourselves being fined because the speed limit on a local sign is referring to a previous seed limit not one now in force.

“ as long as they ride single file…” - Cyclists do not have to ride in single file - many do so out of courtesy to car drivers when needing to overtake, but cyclists are permitted to ride 2 abreast if they desire - which is basically the width of a car.

The number of impatient car drivers who try to overtake a cyclist (or cyclists) in single file when a vehicle is approaching from the opposite direction is unbelievable. I have witnessed this many times and been knocked of my bike twice by idiotic drivers in a rush, sadly this is likely to happen more often now with the changes in speed limits and associated laws…

Cyclists do  not also have to ride in groups of a lot more than 2 taking up the entire lane and causing long queues behind them. That is not courtesy by any means. Cyclists have caused damage to cars by idiot cyclists squeezing down between them at traffic lights and have hit pedestrians coming out of shops by riding on pavements. Some also think they are immune from one way streets and stopping at traffic lights. So, you see, not all are courteous to others. Thought is needed by both.

Maybe I’m missing something.

If the cyclist is doing 20km/h and the speed limit is 20kmh…. there is no need to pass? Is there?

anyway, only Mercedes drivers should be allowed near cyclists as they have the appropriate gun sights on the bonnet to “line em up” 😏 and if the merc driver has a good co-pilot any cyclist out of direct sight can be got with a fling of the door 😂

I’ll get my coat.
