That's terrible - maybe you should contact a tax attorney?

AFAIK The money isn't returned automatically, you have to claim it.

You may need to employ a gestor or solicitor (preferably the one that dealt with your sale) to assist you and you'll need a Spanish bank account to receive any refund.

I don't know the amounts involved but the 3% retention on a 100,000 euro sale would be around 3,000 euro, minus solicitor's fees and any currency transfer fees.

From what I,ve read there is a limited time to claim for the refund and should have been done by your solicitor at time of sale. We sold through sales agent in 2010, who told us we didn't need a solicitor for selling so went ahead, he retained 3000€ on our 100k€ sale. We heard nothing but excuses of" it takes a long time" until I rang after a year to find a differrent agency had taken over business and estate agent had disappeared with clients deposits and customers tax money (such as ours). We were given website of a forum of people who had lost huge money deposits and police were after him. Didn't get him even 5years later. I gave up looking at it. Good luck.

Be very very careful using some so called solicitors, who are

no more than glorified con men. I sold a house10 years ago to an American couple who unfortunately used the same “solicitor” as myself, they also gave home power of attorney and paid 175000  into his account in order to complete the purchase on their behalf, within a month of receiving their 175k he had used the money for his own benefit and never passed the funds onto me, it took 7 years to get him into court and on the day he walked into the court he pleaded guilty told them judge his brother was going to help repay the stolen money and walked out of the court a free man, that was three years ago,a penny has not been repaid, and this conman is walking around after causing huge mental distress to the poor couple who lost 175k, there is so much more I could write about this bandit but I would spend days writing of our bad experiences with the legal process in Spain

The company was called SALAR, in Torrevieja,  the individual was Ignacio Rebas,
