Hello. We are thinking about purchasing a home with a separate guest apartment sometime in the near future somewhere in the La Sella or Monte Pego area. We enjoy many outdoor activities (although golf is not one of them) and find this area very appealing. Does anyone know if we would be required to pay Housing Association or Community fees if the house is located away from the golf course and the property has a private pool. Secondly, is a license required if we plan on renting out only the separate guest apartment? I realize we would need a car to live in either location but we were planning on that anyway. My wife and I are both European and are looking forward to our retirement in Spain. Looking forward to hearing from you and getting to know some of the people there. This would eventually become our permanent residence. Thanks in advance for your answers.

Hard to comment w/o knowing further details. Community fees only apply if you property is in a condo. Before thinking in Tourist letting license be sure that whatever you want to let our meets all the apliccable regulations for this activity. You will need qualified assistance.

As stated above it will depend on where you purchase.  You will need a tourist license to rent out the property.  If you need any help, let me know as we have many agents there who can assist free of charge with your search.

Community fees only apply if the property is on a community.  Regarding rental licenses, you will need to check the property meets the license requirements. Ensure the legal company you use are up to date with the requirements for a Tourist License and know if the local Town Hall are favourable to issuing the Compatibility Certificate required before you can apply for a Tourist License.  You cannot legally let any property for holiday purposes without the license.   

If the original villa has been altered over the years and the 'apartment' is a converted underbuild or extension to the original house, then the changes must be shown in the escritura (deeds).   A lot of converted underbuilds are not legally apartments, still on the official records as store rooms because the work done was never registered, (the owners may not have bothered to obtain planning approval).  Some have low ceiling heights or the windows are too small for them to be used legally as bedrooms etc, but people just kitted the rooms out as space for visiting friends and family anyway.  If that is the case it means  it wont be able to get a Tourist License.  So before you commit to signing anything instruct your solicitors to check these matters.

If you find a property that already has a Tourist License then it is transferable to you on completion of the purchase.
